Marginal Workers

Marginal Workers PDF Author: Ruben J. Garcia
Publisher: NYU Press
ISBN: 0814732216
Category : Business & Economics
Languages : en
Pages : 196

Book Description
Undocumented and authorized immigrant laborers, female workers, workers of color, guest workers, and unionized workers together compose an enormous and diverse part of the labor force in America. Labor and employment laws are supposed to protect employees from various workplace threats, such as poor wages, bad working conditions, and unfair dismissal. Yet as members of individual groups with minority status, the rights of many of these individuals are often dictated by other types of law, such as constitutional and immigration laws. Worse still, the groups who fall into these cracks in the legal system often do not have the political power necessary to change the laws for better protection. In Marginal Workers, Ruben J. Garcia demonstrates that when it comes to these marginal workers, the sum of the law is less than its parts, and, despite what appears to be a plethora of applicable statutes, marginal workers are frequently lacking in protection. To ameliorate the status of marginal workers, he argues for a new paradigm in worker protection, one based on human freedom and rights.

The Sagebrush State, 5th Edition

The Sagebrush State, 5th Edition PDF Author: Michael W. Bowers
Publisher: University of Nevada Press
ISBN: 1943859752
Category : Political Science
Languages : en
Pages : 305

Book Description
Nevada’s politics are in large measure the result of its turbulent history and harsh environment. Michael W. Bowers’ concise volume explains the dynamics of the political formation process, which is strikingly unique among the fifty states. Even today, Nevada is unlike the other states in its politics and culture: it’s economically right, yet libertarian, the home of widespread gaming and a 24/7 lifestyle, has a high percentage of federally-owned lands, and has one of the highest rates of urbanism in the U.S., yet is often governed by rural legislators. This comprehensive and insightful explanation discusses how Nevada’s history has shaped its political culture, and how its government operates today. The Sagebrush State serves as a highly readable and accessible text for the study of Nevada’s political history and constitution, which is a graduation requirement at the state’s colleges and universities. The fifth edition is updated through 2017 and includes the full text of the state constitution with extensive annotations of all amendments to the original 1864 document.

Keeping Faith with the Constitution

Keeping Faith with the Constitution PDF Author: Goodwin Liu
Publisher: Oxford University Press
ISBN: 0199752834
Category : Law
Languages : en
Pages : 274

Book Description
Chief Justice John Marshall argued that a constitution "requires that only its great outlines should be marked [and] its important objects designated." Ours is "intended to endure for ages to come, and consequently, to be adapted to the various crises of human affairs." In recent years, Marshall's great truths have been challenged by proponents of originalism and strict construction. Such legal thinkers as Supreme Court Justice Antonin Scalia argue that the Constitution must be construed and applied as it was when the Framers wrote it. In Keeping Faith with the Constitution, three legal authorities make the case for Marshall's vision. They describe their approach as "constitutional fidelity"--not to how the Framers would have applied the Constitution, but to the text and principles of the Constitution itself. The original understanding of the text is one source of interpretation, but not the only one; to preserve the meaning and authority of the document, to keep it vital, applications of the Constitution must be shaped by precedent, historical experience, practical consequence, and societal change. The authors range across the history of constitutional interpretation to show how this approach has been the source of our greatest advances, from Brown v. Board of Education to the New Deal, from the Miranda decision to the expansion of women's rights. They delve into the complexities of voting rights, the malapportionment of legislative districts, speech freedoms, civil liberties and the War on Terror, and the evolution of checks and balances. The Constitution's framers could never have imagined DNA, global warming, or even women's equality. Yet these and many more realities shape our lives and outlook. Our Constitution will remain vital into our changing future, the authors write, if judges remain true to this rich tradition of adaptation and fidelity.
