L'arrivée en France d'enfants étrangers n'est pas un phénomène récent mais il s'est amplifié ces dernières années. On estime à près de 3000 les enfants étrangers en provenance de pays en guerre, de pays ou la situation politique est tendue, de pays où pauvreté et situation familiale difficile poussent à l'émigration. Certains sont contrôlés à la frontière et placés en zone d'attente, d'autres entrent sur le territoire sans avoir été contrôlés. La nécessité de les protéger conduit à se poser la question de leur statut sur le territoire et des mesures pouvant être prises à leur endroit. La prise en charge des mineurs étrangers témoigne d'une situation juridique complexe ; la difficulté provient principalement de la multitude de situations individuelles que recouvre l'expression « mineur étranger isolé » et de la combinaison chez ce même individu de l'appartenance à plusieurs catégories dont chacune est soumise à un régime distinct. Il est mineur donc incapable civilement, il est isolé d'où l'absence de représentant légal et le besoin d'une protection étatique de substitution. Il est étranger donc soumis au droit des étrangers et parfois au droit d'asile. Chacun de ses aspects est appréhendé en tant que tel parle droit. D'un côté, le droit des étrangers qui impose certaines restrictions aux droits et libertés dont peuvent jouir les étrangers en France, d'un autre côté, celui qui incombe à la protection à la protection juridique du mineur plus respectueuse des intérêts de celui-ci vu qu'elle fait primer par dessus toute autre circonstance l'intérêt supérieur de l'enfant. Ce cloisonnement ne va pas toujours dans le sens d'une reconnaissance et d'une défense des droits des mineurs tels qu'ils sont évoqués dans les instruments juridiques internationaux notamment la Convention des droits de l'Enfant. L'analyse du phénomène permet d'établir que le mineur étranger subi un traitement qui ne donne pas la priorité à sa condition de mineur potentiellement en danger mais que l'accent est mis sur sa condition d'immigrant en situation irrégulière. Dès son arrivée à la frontière, il fait l'objet d'un placement en zone d'attente au même titre que les adultes. La seule mesure spécifique censée le protéger est la présence d'un administrateur ad hoc pour le représenter dans les procédures relatives à son entrée sur le territoire. Les difficultés se poursuivent une fois qu'il a été admis sur le territoire. La priorité accordée à son rapatriement et la réduction des possibilités de régularisation prouve la volonté de ne traiter l'enfant étranger que sous le prisme de l'immigration et non de l'enfance en danger.Cette double qualité d'enfant et d'étranger leur donne légalement droit au bénéfice du dispositif de protection de l'enfance quel que soit leur statut personnel et quel que soit leur situation au regard des règles d'entrée et de séjour. Mais ce dispositif n'est pas adapté a la spécificité de leur situation. Des pratiques des acteurs de la protection de l'enfance tendent à les exclure de la protection de droit commun, pourtant essentielle car elle permet de les prémunir contre certains dangers dont le plus redoutable est sans doute celui de la traite.
