Excerpt from Military Law and the Procedure of Courts-Martial This book has been prepared to meet the existing necessity at the United States Military Academy for a text-book which would give a clear and thorough outline of the science of military law, including all recent changes and developments, and yet be contained within such brief compass as to he adapted for use in the instruction of Cadets within the limited period assigned to the study of the subject. The work also aims to deal with the general procedure of courts-martial and to set forth that procedure and existing military laws in such a manner as to make a text of practical use to the, service at large. The author wishes to acknowledge the constant and valuable assistance received from the Assistant Professor and Instructors in the Department of Law at the Military Academy, who, during the past year, have given instruction in the text as tentatively prepared and have made suggestions and criticisms which have resulted in a clearer and better presentation of the subject matter and the elimination of some errors. These officers are: Captain J. K. Moore, 15th U. S. Infantry, Assistant Professor; First Lieutenants Irvin L. Hunt, 19th Infantry; Halsey E. Yates, 5th Infantry; Edwin G. It was an era of religious rather than civil agitation; foreign wars, involving important military operations on land, were infrequent, and the policy of the Govern ment, especially during the long reign of Elizabeth, was one of internal and economic development, and of neutrality or non-interference in foreign affairs. The result was to defer the discussion of purely constitutional ques tions, and to delay the final distribution of sovereign powers between the legislative and executive departments of the government for more than a century. During this epoch, however, Englishmen were not permitted to forget the existence of martial law; although the occasions for its exercise were less frequent than they had been during the disturbed reigns of the Houses of Lancaster and York, and were, perhaps, more nearly justified by the facts of existing emergencies than was the case during the first half of the period of Stuart rule. I have given details as to the Prosecutor and President regarding the various courts, and it is very essential that the facilities and privileges that the accused is entitled to, both before the assembly of the Court and during the trial, should be understood by all officers. I have confined myself to the procedure of courts martial only. As regards the various offences, see the Army Act sections 4 - 41 Manual of Military Law, pages 371, 372 and 378 - 413. Chapter V of the Manual of Military Law should be read, pages 35 - 54, and the Rules of Procedure, Manual of Military Law, pages 571 - 642. It is advisable, when the Court is sitting, to keep the memoranda before the Court as laid down in the Manual of Military Law, page 703 and when determining the sentence King's Regulations para 583 (xi) may be referred to with advantage. F or this progressive movement, we are mainly indebted to the able decisions, while reviewing the proceedings Of courts-martial, that have issued from the War Department since the establish ment of the office of Judge Advocate of the Army and to the many elaborate Opinions by the Attorneys General, on points of law requiring legal interpretation. These decisions and opiu ions, presenting, as they do, authoritative information of nu usual interest to the army at large and not generally accessible, first suggested the preparation of a work in which they might be embodied. The suggestion lost none of its force, in view Of the fact, that for the instruction of the Cadets of the Military Academy in the practice of courts-martial, this most essential information was not to be found in their text-book. This volume has been the result of much careful investiga tion, and the hope is entertained that it may contribute a use ful link in the chain of our military jurisprudence.
