La violencia de género es uno de los hechos más execrables en nuestra sociedad. La lucha contra la misma de manera integral data de 2004, y desde ese momento a la actualidad las cifras no han hecho sino constatar una triste realidad: siguen muriendo mujeres a manos de sus compañeros sentimentales. La ley ha previsto un gran número de medidas para erradicarla, entre ellas cabe mencionar las de naturaleza procesal, con las que se pretende prevenir la violencia sobre las mujeres, así como protegerlas. Pero los efectos de dichas medidas no han sido los esperados, los hombres siguen violentando a sus compañeras, y las mujeres se sienten cada día más revictimizadas, por ello cabe plantearse lo adecuado de las soluciones legales arbitradas. Además, existen otros datos que llaman la atención y son los relativos al escaso número de mujeres que decide denunciar y acudir a los procesos judiciales. Las estadísticas nos dicen que incluso las mujeres que mueren a manos de sus compañeros o excompañeros no han denunciado en un importante porcentaje. Cabe plantearse cuál es la razón que provoca esta circunstancia y atajarla para así encontrar una manera más eficaz para afrontar esta lacra. Otra cuestión que nos preocupa es si el legislador ha olvidado que además de conflictos que están tipificados como ilícitos penales, son también conflictos que tienen su base en las relaciones afectivas, y muchas veces en el seno de una familia, por lo que su tratamiento debiera ser diverso al de otro tipo de ilícitos. ¿Es correcta, por tanto, la normativa existente en este momento? ¿Es el momento oportuno, con una ley que tan sólo lleva en vigor 4 años, de plantearnos reformas? ¿Cuáles debieran ser estas? En este marco pretendemos, como objetivo esencial, buscar nuevas medidas que sirvan en la lucha contra la violencia de género. En otros países la mediación es un instrumento enormemente apto para ello, como mecanismo de prevención, y en muchos supuestos de evitación de sucesivos actos. Siendo así se procederá al análisis del derecho comparado, al estudio de la metodología de la mediación como mecanismo alternativo de solución de conflictos, a la evaluación de las víctimas de violencia de género así como de sus agresores, y por último a la determinación de la mediación como mecanismo o no apto en determinados supuestos de violencia sobre la mujer.
