La question de la limitation ou arrêt des traitements (LAT) chez le patient en fin de vie a fait débat ces dernières années dans les milieux scientifiques et éthiques avant d'être médiatisée et d'aboutir à une réflexion politique et la mise en place d'une loi relative à ces patients. Alors que les droits de ces patients ont été établis et détaillés, les situations vécues par les soignants peuvent poser encore des problèmes moraux et éthiques pour apporter les soins adéquats aux patients en fin de vie, notamment lorsque ces patients sont dans l'incapacité de se prononcer sur leurs désirs propres. La place du médecin traitant comme aide déontologique à cette décision a été plusieurs fois évoquée mais très peu étudiée, encore moins du point de vue du médecin généraliste, élément pourtant central de cette problématique et pourtant trop souvent exclu de ce processus. En outre, la pratique du généraliste dépend de facteurs d'influence tels que l'offre de soins en fonction de son lieu et type d'exercice notamment, alors que les droits des patients en fin de vie sont définis de manière unanime et sans équivoque. Cette thèse cherche ainsi à décrire le rôle du médecin généraliste dans cette problématique, en le confrontant à son cadre d'exercice. Nous avons ainsi interrogé 50 généralistes dans toute la France et dans les DOM, tous suivant ou ayant déjà suivi un patient en fin de vie. 28% d'entre eux n'avaient jamais été sollicités pour participer à une décision de LAT, et près d'1/3 de ceux-ci exerçaient en milieu rural. La prise de décision sans participation du médecin concernait à 60% des médecins ruraux. Néanmoins 98% d'entre eux souhaitent leur implication dans ce processus.

Objectifs : Déterminer l'application de la procédure collégiale par les omnipraticiens lors des limitations ou arrêts de thérapeutiques en dehors de l'hôpital, pour les patients en fin de vie incapables de s'exprimer. Identifier les mécanismes qui induisent ces pratiques. Méthode : Étude qualitative semi directive réalisée auprès de 13 médecins généralistes d'Île-de-France. Résultats : Les médecins généralistes de ville sont fortement impliqués dans la prise en charge des patients en fin de vie à domicile. Toutefois, les médecins méconnaissent l'obligation de la mise en œuvre d'une procédure collégiale avant toute limitation ou arrêt de traitement dont l'absence est susceptible d'entraîner le décès du patient. Les contraintes liées à l'organisation de l'exercice de ville, la spécificité de cet exercice vis-à-vis de l'entourage du patient, l'isolement professionnel et le manque de reconnaissance ressenti par les médecins généralistes explique l'absence de collégialité dans les pratiques extrahospitalières. Le défaut de promotion de la loi Léonetti par les pouvoirs publics éclaire sur la méconnaissance de cette procédure par les omnipraticiens. Conclusion : La procédure collégiale n'est pas encore intégrée dans la démarche de prise de décisions des généralistes lors de l'arrêt ou la limitation de thérapeutique des patients en fin de vie. La modification récente de la loi dite Léonetti doit être l'occasion de mettre en avant cette disposition pour espérer un changement dans les pratiques.

L'abstention thérapeutique ou la limitation des traitements est une question délicate à laquelle les médecins généralistes sont confrontés, en particulier auprès des personnes âgées souffrant de polypathologies et parfois de handicaps. Alors que des recommandations hospitalières existent, ainsi qu'une récente loi relative aux droit des malades et à la fin de vie, nous avons cherché à savoir comment les médecins généralistes vivaient ce type de situation au quotidien. Méthode – Pour cela, nous avons réalisé une étude qualitative à partir d'entretiens semi-dirigés auprès de vingt médecins généralistes tirés au sort sur l'ensemble du département de la Loire. Nous leur avons proposé de décrire la dernière expérience pour laquelle ils avaient été amenés à décider de la mise en oeuvre d'une abstention thérapeutique, ou une limitation des soins chez un patient de plus de 75 ans. Il s'agissait de préciser le contexte, d'identifier les personnes qui étaient intervenues dans la décision, de décrire la décision prise est ses conséquences, et de savoir enfin si les traces de cette décision apparaissaient dans le dossier médical. Les situations qui ont conduit les médecins généralistes à la décision d'abstention thérapeutique, ou de limitation de traitements, sont hétérogènes. Parfois la décision a été prise dans l'urgence. Les médecins décrivent des relations relativement simples avec leurs patients qui sont, lorqu'ils sont conscients et compétents, informés et consentants. Le refus de soins par les patients restent cependant une situation difficile pour les médecins généralistes. Ceux-ci notent l'absence de demande anticipée, et de personne de confiance désignée. Par contre, ils soulignent les difficultés relationnelles qui interviennent fréquemment dans les familles et qui peuvent compromettre la décision. Les médecins généralistes soulignent leur solitude dans la décision. La relation avec le personnel paramédical est souvent perçue comme délicate, du fait de l'absence de lieu d'exercice commun et d'opinions parfois divergentes. Le personnel médical est souvent limité au seul médecin généraliste, même s'il ne manque pas de prendre l'avis d'un confrère si la situation s'y prête. Enfin, le médecin généraliste n'inscrit pas toujours sa décision explicitement sur le dossier médical. L'expérience rapportée par les médecins montre par ailleurs leur forte implication éthique. Contrairement à des situations bien définies et objets d'un relatif consensus, comme celle de l'arrêt et de la limitation des traitements actifs en réanimation, où des décisions collégiales peuvent être prises, le médecin généraliste, quant à lui, est confronté le plus souvent seul à des expériences diverses et hétérogènes en terme de limitation de traitement ou d'abstention thérapeutique à l'âge avancé. Si la particularité de la médecine générale est d'être un exercice de proximité avec le patient et la famille, la communication et la compréhension de ces personnes restent un enjeu. La réalité du terrain rend souvent une décision collégiale difficile. Le médecin généraliste aura peut-être à inventer des solutions spécifiques, pour lui permettre une pratique et une réflexion éthique moins solitaires. Les textes législatifs et les recommandations récentes concernant l'arrêt ou la limitation des soins en fin de vie sont des repères pour aider le médecin dans sa pratique, néanmoins, leur application sur le terrain reste un enjeu complexe.

In this classic of French cultural studies, Georges Didi-Huberman traces the intimate and reciprocal relationship between the disciplines of psychiatry and photography in the late nineteenth century. Focusing on the immense photographic output of the Salpetriere hospital, the notorious Parisian asylum for insane and incurable women, Didi-Huberman shows the crucial role played by photography in the invention of the category of hysteria. Under the direction of the medical teacher and clinician Jean-Martin Charcot, the inmates of Salpetriere identified as hysterics were methodically photographed, providing skeptical colleagues with visual proof of hysteria's specific form. These images, many of which appear in this book, provided the materials for the multivolume album Iconographie photographique de la Salpetriere. As Didi-Huberman shows, these photographs were far from simply objective documentation. The subjects were required to portray their hysterical "type"—they performed their own hysteria. Bribed by the special status they enjoyed in the purgatory of experimentation and threatened with transfer back to the inferno of the incurables, the women patiently posed for the photographs and submitted to presentations of hysterical attacks before the crowds that gathered for Charcot's "Tuesday Lectures." Charcot did not stop at voyeuristic observation. Through techniques such as hypnosis, electroshock therapy, and genital manipulation, he instigated the hysterical symptoms in his patients, eventually giving rise to hatred and resistance on their part. Didi-Huberman follows this path from complicity to antipathy in one of Charcot's favorite "cases," that of Augustine, whose image crops up again and again in the Iconographie. Augustine's virtuosic performance of hysteria ultimately became one of self-sacrifice, seen in pictures of ecstasy, crucifixion, and silent cries.
