Unbeknownst to most, the Luyia Nation is a congeries of Bantu and assimilated Nilotic clans principally the Luo, Kalenjin, and Maasai. Created seventy years ago, the Luyia tribe is still evolving in a slow process that seeks to harmonize the historico-cultural institutions that define the eighteen subnations in Kenya alone. Available records indicate that geophysical spread of Luyia-speaking people extends beyond the Kenyan frontier into Uganda and Tanzania with some Luyia clans having extant brethren in Rwanda, Congo, Zambia, and Cameroon. The 862 Luyia clans in Kenya are amorphous units united only by common cultural and linguistic bonds. The political union between these clans is a pesky issue that has eluded the community since formation of the superethnic polity. Although postindependence scholars dismissed oral accounts of Egyptian ancestry, new anthropological evidence links the Bantu, including those in West Africa, to ancient Misri (Egypt). A major historical and cultural change in Buluyia occurred a little more than a century ago when natives first made contact with the Western world. The meeting in 1883 by a Scottish explorer, Joseph Thomson, with Nabongo Mumia, the Wanga king, laid the foundation for British imperialism in this part of Africa.

This book sets out to probe, explore and evaluate the betrayal of anticolonial nationalism in Kenya. Contemporary Kenya’s emergence is rooted in the colonial enterprise, its deleterious effects and the subsequent decolonization spearheaded by a fierce anti-colonial nationalism that was embodied in freedom struggles at the cultural, political, and military levels. As a settler colony, the colonial settlers hived off millions of hectares of the best land in the highland areas of Kenya and appropriated them for themselves thereby generating a large mass of the landless. This land alienation constituted one of the most deeply felt grievances which, together with the exclusivist, exploitative and oppressive colonial system, inflamed anti-colonial nationalism that undergirded the struggle for independence. The expectation on the part of the masses was that independence would bring about social justice, restitution of the stolen lands, and a government based on the will and aspirations of the governed. Political developments soon after independence, however, demonstrated the extent of betrayal of the cause of anti-colonial nationalism, which has remained the reality to date. This book covers the extent of this sense of betrayal from the time of independence to the present. It begins by locating contemporary Kenya within the colonial context then proceeds to thematic issues of betrayal including the fall out between President Kenyatta and Vice President Odinga over ideology and issues of development, which constituted the first betrayal; the scourge of bureaucratic corruption and rent seeking; the question of land and associated historical injustices; and electoral malpractice since the return of multiparty politics in 1992 to the most recent elections of 2022. The implications of these dynamics for the future of the Kenyan polity are delineated and discussed.

Kenya's Independence Constitution: Constitution-Making and End of Empire, by Robert M. Maxon, is a narrative of the evolution of the constitution that was put into effect as Kenya's history as a colonial possession came to an end. It details the attempts of the colony's political elite and the British Colonial Office to find a constitutional means to move Kenya to the status of independent state. As this process moved forward, political ethnicity assumed central significance. This produced an environment in which demands for a federal constitution, popularly termed majimbo, came to dominate constitutional discourse. Deep disagreement among Kenya's political elite over this issue marked the remainder of the colonial period. That elite, now represented by the Kenya African National Union (KANU) and the Kenya African Democratic Union (KADU), advocated different constitutional paths to independence. KADU's demands for a majimbo constitution dominated discourse during 1962 and early 1963, but deep disagreement characterized the constitutional negotiations. This resulted in a constitution for self-government (introduced on June 1, 1963) that was regional in character but fell short of a federal system. Almost as soon as it came into existence, this constitution faced pressure for substantial change from KANU, the party that won the 1963 general election. As a result, the British government was forced to make alterations in what became the independence constitution. The latter proved a prelude to the destruction of majimbo a year later. Kenya's Independence Constitution provides the first in-depth description of the final stage of colonial Kenya's constitutional evolution. The book not only provides a detailed account of the process of constitution-making, including definitive treatments of the final two constitutional conferences of 1962 and 1963. Utilizing British and Kenya cabinet papers and secret intelligence reports never featured in earlier accounts, the narrative also destroys many of the myths that have long been associated with Kenya's decolonization, such as the alleged favoritism for federalism and support given by the colonial state and Colonial Office to KADU and the reasons for KANU's hostility to the self government constitution. It makes a particularly significant contribution by illuminating the genesis of KADU's majimbo policy and emphasizing the African agency involved. The book is most timely as the Kenya political elite struggles to find a new constitutional order to replace that which had its roots in the independence constitution.
