The Ombudsman in the Modern State
Author: Matthew Groves
Publisher: Bloomsbury Publishing
ISBN: 1509943250
Category : Law
Languages : en
Pages : 411
Book Description
Ombudsmen are a global phenomenon. They are also a critical part of the public law frameworks of modern liberal democracies. This is the first edited collection to examine the place of the ombudsman in the modern state. It brings together key international scholars to discuss current and future challenges for the Ombudsman institution and the systems of government within which they operate. The book is international in scope with authors heralding from most continents - Canada, the Netherlands, the United Kingdom, Australia, New Zealand, Hong Kong, South Africa, Germany, and Austria. This global analysis is both in-depth and expansive in its coverage of the operation of Ombudsmen across civil and common law legal systems. The book has two key themes: - The enduring question of the location and operation of Ombudsmen within public law systems in a changing state, and - The challenges faced by Ombudsmen in contemporary governance. This collection adds to the public law scholarship by addressing a common problem faced by all avenues of public law review – the evolving nature of modern public administration.

Administrative redress
Author: Great Britain: Law Commission
Publisher: Editions de l'Atelier
ISBN: 9780102966244
Category : Business & Economics
Languages : en
Pages : 80
Book Description
In this report the Law Commission sets out conclusions from its review of administrative redress in public and private law following consultation (Law Commission consultation paper 187, 2008, ISBN 9780118404532). The aim of the Commission's review was to consider when and how individuals should be able to obtain redress against public bodies that have acted in a substandard way. The report discusses individuals' access to remedies through the courts, as well as through avenues outside the court system, such as the public sector ombudsmen. In examining court-based remedies, the Commission concludes that there are good arguments for reform but, given the level of opposition to its earlier proposals and the absence of available data on the costs of compensation paid by public bodies, work will not be taken forward on reviewing this area of the law. The report does, however, recommend that government should establish a process for collecting and publishing information on the cost of public compensation. The Commission is taking forward its review of the public sector ombudsmen, following a favourable response to its proposals. The scope of the review will be extended and include suggestions for improving citizens' access to the public sector ombudsmen, and increasing the powers of ombudsmen to refer points of law to the courts. The Commission will consult on its proposals for reform of public sector ombudsmen later in 2010 and expects to make final recommendations to government the following year.

International Perspectives on Maladministration in Education shines a light on this complex topic by examining various practices at individual, group, organisational, and system levels; the contexts and influences that give rise to them; and potential remedies to ensure more accountable, just, and safe institutions.

Injustice Unremedied
Author: Great Britain. Parliamentary and Health Service Ombudsman
Publisher: The Stationery Office
ISBN: 9780102959444
Category : Business & Economics
Languages : en
Pages : 26
Book Description
In July 2008 the Parliamentary and Health Service Ombudsman presented a report concerning the prudential regulation of the Equitable Life Assurance Society (HC 815, session 2007-08, ISBN 9780102957303). The report made ten findings of maladministration, determined that this maladministration had led to injustice, and made two recommendations: that the Government should apologise to policyholders for the serial regulatory failure and; that the Government should establish and fund a compensation scheme. The Public Administration Select Committee also reported on this matter: "Justice delayed" (HC 41-1, session 2008-09, ISBN 9780215525536). On 15 January 2009 the Government published their response: "The prudential regulation of the Equitable Life Assurance Society" (Cm. 7538, ISBN 9780101748124). The Government accepted some, but not all, of the Ombudsman's findings and apologised to policyholders. The Government decided to reject the central recommendation - that the Government should establish and fund a compensation scheme. Instead Sir John Chadwick was appointed to advise the Government on the extent of relative losses suffered and what proportion might be attributed to the maladministration before some ex gratia payments were made. This report presents the Ombudsman's assessment of the Government's response. She is disappointed that the Government rejected many of the findings and is unpersuaded by the basis for those rejections. The Ombudsman has three concerns about the "alternative approach" or Chadwick process, which she brings to Parliament's attention: it breaks the link between injustice and remedy; the lack of clarity about the process; selective use of the Penrose report in the Government response.
