The Patent and Trademark Amendments of 1980 (Public Law 96-517) established a uniform patent policy for small businesses and nonprofit organizations that gives them, with limited exceptions, the option to retain title to inventions resulting from federally sponsored research projects. This is the second annual report submitted by the Comptroller General on how federal agencies are carrying out this law. Major federal research and development agencies have incorporated provisions of the law and Office of Management and Budget (OMB) guidance into their procurement regulations to ensure uniform implementation throughout the agencies. Only two agencies--the Department of Energy (DOE) and the National Aeronautics and Space Administration (NASA)--have reported determinations to withhold from certain inventors the rights to inventions resulting from agency-sponsored projects.

GAO reported on activities of Federal agencies under Chapter 18 of the Patent and Trademark Amendments of 1980, as required by law. Chapter 18 of the law establishes a uniform patent policy for assigning title to inventions made by small businesses and nonprofit organizations under federally sponsored research projects. Specifically, GAO reviewed: (1) Federal research and development (R&D) agencies' implementation of Public Law 96-517 and Office of Management and Budget (OMB) Circular A-124; (2) the Department of Commerce's efforts to fulfill its lead agency responsibilities outlined in the OMB circular; and (3) Federal R&D agencies' exceptional circumstance determinations. GAO also provided an update on the President's proposed changes in Government patent policy to apply Public Law 96-517 provisions to all contractors. GAO found that all five Federal R&D agencies incorporated provisions of the law and regulations into their procurement regulations and that Commerce is monitoring Federal agencies' regulations and procedures for implementing the law. GAO noted that the Department of Defense did not submit the documentation that Commerce requested but did respond orally. OMB is reviewing Commerce's efforts to implement Circular A-124. As of December 1, 1983, the Comptroller General received seven exceptional circumstance determinations, six from the Department of Energy and one from the National Aeronautics and Space Administration. However, GAO found that no pattern of exceptional circumstance determinations exists that is contrary to the policy or objectives of the law or not in conformance with it.

The Patent and Trademark Amendments of 1980 allows small businesses and nonprofit organizations the option to retain title to inventions resulting from federally sponsored research projects. This law also reiterates federal agencies' authority to grant licenses for inventions that they own. In February 1983 President Reagan directed federal agencies, to the extent permitted by law, to adopt substantially the same policies set forth in the law for all contractors as well as for small business and nonprofit organizations. GAO found that the 10 federal agencies that accounted for 98 percent of the total actual and estimated federal research and development (R & D) obligations in fiscal years 1983 and 1984, respectively, are allowing grants, contracts, and cooperative agreements recipients to retain title to inventions discovered while performing federally funded research projects. These agencies are also granting licenses for inventions that they own. In addition, GAO found that the Commerce Department is fulfilling its lead agency role of monitoring federal agencies' implementation of the law. Also, federal officials and representatives of various small business' and nonprofit organizations' trade associations and interest groups have mixed perceptions of whether the law has caused any increases or decreases in their groups' R & D activities. As required by the Patent and Trademark Amendments of 1980, GAO reviewed the actions taken by Federal agencies to implement the Act's guidelines which establish a uniform policy for assigning titles to inventions by small businesses or nonprofit contractors during Government-sponsored research. Under the provisions of the Act, GAO is responsible for monitoring how well the guidelines are being enacted and for determining whether an agency determination is contrary to the Act's policies and objectives. It is too early to draw any conclusions about the guidelines; however, preliminary assessments of agency actions and the regulations issued to put the law into effect promise that the goal of uniformity may be achieved.
