A comprehensive body of evidence—2,700 court opinions—describes a society characterized by a presupposed absence of physical and emotional intimacy, affection, and personal connections. In compelling, poignant, and sometimes horrifying court cases, West finds that Japanese judges frequently opine on whether a person is in love, what other emotions a person is feeling, and whether those emotions are appropriate for the situation. Sometimes judges’ views about love, sex, and marriage emerge from their presentation of the facts of cases. Among the recurring elements are abortions forced by men, compensated dating, late-life divorces, termination fees to end affairs, sexless couples, Valentine’s Day heartbreak, "soapland" bath-brothels, and home-wrecking hostesses. Sometimes the judges’ analysis, decisions, and commentary are as revealing as the facts. Sex in the cases is a choice among private "normal" sex, which is male-dominated, conservative, dispassionate, or nonexistent; commercial sex, which caters to every fetish but is said to lead to rape, murder, and general social depravity; and a hybrid of the two, which commodifies private sexual relationships. Marriage is contractual; judges express the ideal of love in marriage and proclaim its importance, but virtually no one in the court cases achieves it. Love usually appears as a tragic, overwhelming emotion associated with jealousy, suffering, heartache, and death.

Beginning in the nineteenth century, law as practice, discourse, and ideology became a powerful means of reordering gender relations in modern nation-states and their colonies around the world. This volume puts developments in Japan and its empire in dialogue with this global phenomenon. Arguing against the popular stereotype of Japan as a non-litigious society, an international group of contributors from Japan, Taiwan, Germany, and the U.S., explores how in Japan and its colonies, as elsewhere in the modern world, law became a fundamental means of creating and regulating gendered subjects and social norms in the period from the 1870s to the 1950s. Rather than viewing legal discourse and the courts merely as technologies of state control, the authors suggest that they were subject to negotiation, interpretation, and contestation at every level of their formulation and deployment. With this as a shared starting point, they explore key issues such reproductive and human rights, sexuality, prostitution, gender and criminality, and the formation of the modern conceptions of family and conjugality, and use these issues to complicate our understanding of the impact of civil, criminal, and administrative laws upon the lives of both Japanese citizens and colonial subjects. The boys love (BL) genre was created for girls and women by young female manga (comic) artists in early 1970s Japan to challenge oppressive gender and sexual norms. Over the years, BL has seen almost irrepressible growth in popularity and since the 2000s has become a global media phenomenon, weaving its way into anime, prose fiction, live-action dramas, video games, audio dramas, and fan works. BL’s male–male romantic and sexual relationships have found a particularly receptive home in other parts of Asia, where strong local fan communities and locally produced BL works have garnered a following throughout the region, taking on new meanings and engendering widespread cultural effects. Queer Transfigurations is the first detailed examination of the BL media explosion across Asia. In contemporary Japan, 85% of children in alternative care remain housed in large welfare institutions, as opposed to family-based foster care. This publication examines how Japan has been isolated from global discourse on alternative care, urging a shift in social work and alternative care policies. As the first ethnographic account from inside child guidance centres, it makes a key contribution towards understanding the closed world of Japan’s social services; including the decision-making processes by which a child is removed from the family and placed into care. In addition, regional variation in policy implementation for alternative care is outlined, with reference to detailed case studies and a discussion around organisational cultures of the child guidance centres. Where foster care is constructed as anything other than professional, it is often seen as a threat to the child’s family-bond with their natal parent and therefore not used.
