Bajo la expresión «cesión de derechos de imagen», suelen quedar encuadrados los efectos de los contratos que tienen por objeto el derecho a la propia imagen. Pero, ¿implican estos contratos realmente una cesión? ¿Tienen las sociedades beneficiarias de estos contratos la posición jurídica de un cesionario exclusivo, como, p. ej., el cesionario de derechos propiedad intelectual o industrial? La presente obra analiza la disposición y transmisión de los derechos reconocidos en el ordenamiento español a la persona sobre la explotación económica de los atributos o elementos distintivos de su identidad. Para ello, la obra aborda, en primer lugar, la definición normativa de los derechos de la personalidad incorporal y de los llamados derechos de imagen, especialmente a la vista de su posible disponibilidad y transmisibilidad; en segundo lugar, expone los rasgos teóricos y normativos del consentimiento o autorización para la intromisión en los derechos de la personalidad en la LO 1/1982 y sus efectos; y, en fin, identifica los expedientes y regulación de la transmisión inter vivos y mortis causa de los derechos de imagen en Derecho español. De este modo, la obra se orienta a resolver los recurrentes problemas jurídico-privados de orden práctico que se producen en el denominado mercado de los derechos de imagen, así como también, en menor medida, en los contratos sobre la explotación de la intimidad.

This report considers the biological and behavioral mechanisms that may underlie the pathogenicity of tobacco smoke. Many Surgeon General's reports have considered research findings on mechanisms in assessing the biological plausibility of associations observed in epidemiologic studies. Mechanisms of disease are important because they may provide plausibility, which is one of the guideline criteria for assessing evidence on causation. This report specifically reviews the evidence on the potential mechanisms by which smoking causes diseases and considers whether a mechanism is likely to be operative in the production of human disease by tobacco smoke. This evidence is relevant to understanding how smoking causes disease, to identifying those who may be particularly susceptible, and to assessing the potential risks of tobacco products.
