L'auteur démontre, à travers l'étude du contentieux des subventions à l'exportation (sociétés de vente à l'étranger) et l'analyse de deux affaires commerciales qui ont défrayé la chronique jurisprudentielle de l'OMC (Airbus contre Boeing et Boeing contre Airbus), tant par leur durée que par leur absence de dénouement, que l'institution gendarme du commerce mondial s'avère bien souvent impuissante à résoudre certains contentieux présentés devant elle par des États Membres.
