With the introduction of the economic reforms in the late 1980s, the opening up of the political arena and the end of the civil war in the early 1990s, the decentralization process began in Mozambique. Different research developed in recent years shows that, as is the case in other countries in sub-Saharan Africa, the impact of the decentralization reforms on the promotion of local development and the strengthening of democracy in Mozambique is modest. How can this modest impact be explained? Based on three important reforms in the decentralization process in Mozambique, namely the '7 million', municipalization and decentralized provincial governance, this article seeks to answer this question by analysing how different aspects of the institutions affect the results of the reforms. The main argument in the article underlines the idea according to which the results of the decentralization reforms in Mozambique are constrained by the nature and by the operation mechanisms of the political system. Of these institutional factors/constraints, state capacity and independence from private interests, particularly political groups, stand out in the three reforms analysed throughout this article. In this context, the reforms develop according to group interests, particularly party political interests, which capture the state and use the reforms as a mechanism for maintaining and bolstering political power. In this sense, rather than being a means of improving the provision of public services and strengthening democracy, decentralization works more as an instrument for reinforcing state control and pandering to the elite. This is probably the biggest challenge decentralization is facing in Mozambique, therefore making it a fundamental issue to be taken into account in any reform in this area, within the context of strengthening democracy and promoting local development.

"The Mozambique land law provides statutory recognition of customary land rights and is considered one of the most progressive legislations in Africa. However, the law continues to face implementation challenges, including the realization of equal rights for women and institutional reform. Simply having a progressive law 'is not enough' to bring about transformative change in a country. Recognizing these challenges, the Food and Agriculture Organization of the United Nations (FAO) developed a programme to support the legislation through the capacity development of both direct beneficiaries and those responsible for implementing it. This publication presents an overview of how this programme developed and what it has achieved to date. It highlights the lessons learned from this core element of FAO's long history of support to the land programme in Mozambique. In particular, the study discusses the challenges facing land and natural resources paralegals in Mozambique today and helps to define the parameters for programme assessment by looking at paralegals in different country contexts. Municipalities in Mozambique were established by law in 1997 and elected in 1998 for the first time, only a few years after the peace agreement. Most inherited archaic and dysfunctional remnants of colonial and central government systems and infrastructure, and as such limited progress was achieved in transforming them into functioning local governments during the first mandate (1998-2002). During the second mandate (2003-2008), however, significant improvements were seen as municipalities began to grasp the nettle of local governance and some service delivery challenges. By the end of their first decade most municipalities have reorganized themselves to some extent and a number have undertaken initiatives that are beginning to bear fruit. There remains a long way to go, however, before municipalities will be robust enough to deliver quality local services to meet growing demand. There is a danger that the pace of municipal technical and financial capacity development will be overtaken by the growing municipal population and by transfers of additional mandates. Municipalities, central government, and the Association of Municipalities (ANAMM) need to support municipalities to perform their potentially significant role in improving living conditions, stimulating growth and cementing meaningful democracy in Mozambique. This study provides the first integrated assessment of the challenges of local development and service delivery through a municipal lens. It diagnoses the underlying systemic constraints facing municipalities, discusses some of the specific service delivery challenges of the municipalities, and it sets out recommendations for both central and municipal governments to tackle some of these constraints within an integrated and systemic framework.
