Cent ans après Saleilles, l'individualisation de la peine demeure une question d'actualité. Même rebaptisée dans le nouveau Code pénal sous le terme de personnalisation, l'individualisation n'a cessé d'être la clé de voûte de la pénologie moderne. Le principe s'impose avec une telle évidence qu'il n'a jamais paru devoir être sérieusement mis en cause. La pratique quotidienne comme le résultat des recherches empiriques montrent cependant les limites rencontrées lors de la mise en œuvre du principe. Pour comprendre les raisons d'un tel paradoxe, il convient de revenir aux sources et donc à Saleilles et à son ouvrage paru en 1899. Cent ans après sa parution, une réédition s'imposait et le lecteur constatera que déjà, Saleilles pointait toute la difficulté que représente la conciliation entre le besoin d'expiation éprouvé par le corps social, et la nécessité de proportionner la peine à la personnalité de l'individu. Aujourd'hui, en dépit des progrès réalisés dans le domaine des sciences criminelles, la recherche d'un juste équilibre demeure tout aussi aléatoire. Le souci d'égalité vient-il s'opposer à celui de l'individualisation de la peine ou au contraire justifie-t-il sa mise en œuvre ? Les peines constituent-elles des modes de gestion de l'indignation sociale ? Qu'en est-il de leur fonction de réinsertion ? Existe-t-il des instruments de sanction pénale intégrés à la vie sociale sans toutefois être destructeurs de l'individu ? De quels moyens matériels et techniques disposent les services judiciaires et pénitentiaires pour mettre en œuvre l'individualisation de la peine, qu'il s'agisse du choix de la sanction ou des modalités de son exécution ? Les différents spécialistes de la criminologie réunis dans cet ouvrage nous invitent à réfléchir à la vision de l'homme qui sous-tend aujourd'hui le système de justice pénale constitué d'infractions et de sanctions. The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention.
