La ordenación de la competencia en el mercado y la regulación de las relaciones laborales han mantenido a lo largo de su evolución un diálogo permanente con múltiples escenarios de conflicto. Durante las dos últimas décadas, las manifestaciones de esta interacción entre la legislación de defensa de la competencia y el derecho del trabajo, han aumentado tanto en el plano comunitario como en el ámbito estatal, en ausencia de parámetros normativos que regulen esta relación. La presente monografía analiza en primer lugar cómo el desarrollo del derecho comunitario de la competencia ha afectado a diversas instituciones estatales ligadas a las relaciones de trabajo, entre las que se encuentran servicios públicos de empleo, regímenes de seguridad social y convenios colectivos. La segunda parte del presente estudio se centra en el plano estatal, donde las autoridades de defensa de la competencia han cuestionado diversos convenios colectivos y actuaciones sindicales, aplicando la Ley de Defensa de la Competencia. El estudio concluye con el planteamiento de una serie de propuestas de articulación entre el derecho del trabajo y la defensa de la competencia, orientadas a conseguir una convivencia correcta y razonable de los mismos.

The book also discusses how alternative methods of dispute settlement can relate to this topic, and the important role that private international law plays in access to remedy for corporate-related human rights abuses. This collection comprises 20 national reports from jurisdictions in Europe, North America, Latin America and Asia, addressing the private international law aspects of corporate social responsibility. They provide an overview of the legal differences between geographical areas, and offer numerous examples of how states and their courts have resolved disputes involving private international law elements. The book draws two preliminary conclusions: that there is a need for a better understanding of the role that private international law plays in cases involving transnational elements, in order to better design transnational solutions to the issues posed by economic globalisation; and that the treaty negotiations on business and human rights in the United Nations could offer a forum to clarify and unify several of the elements that underpin transnational disputes involving corporate human rights abuses, which could also help to identify and bridge the existing gaps that limit effective access to remedy.
