Dans le présent essai l'auteur s'interroge sur le devenir du droit du travail, qu'il perçoit comme une correction sociale marginale au marché libre du travail et à la concurrence sociale. Certains phénomènes laissent supposer qu'on assiste à une mutation et à une évolution d'un droit du travail protecteur vers un droit de la concurrence sociale responsabilisant. L'inégalité économique entre le travailleur et son employeur constitue de moins en moins un facteur d'importance dans la conception du nouveau droit du travail. Le travailleur, censé être devenu autonome, décide librement et consciemment de ses actes et en est pleinement responsable. La concurrence sociale, autrefois désignée comme source d'exploitation et d'exclusion sociales, est perçue comme bénéfique pour la qualité du travail. Le législateur n'est plus appelé à corriger la compétition entre les travailleurs; il doit seulement l'accompagner et en sanctionner les abus manifestes. L'internationalisation et l'européanisation du marché du travail ont profondément modifié les rapports de force entre le travail et le capital. Les législateurs du travail nationaux n'arrivent plus à contrôler et à gérer convenablement le marché du travail et la concurrence sociale qu'il génère. Le droit de la dignité de l'Homme au travail semble (re)mis en cause. En se penchant sur les causes structurelles de cette évolution, l'auteur propose en toute modestie quelques démarches juridiques et institutionnelles, destinées à sauvegarder l'essentiel du droit de la protection des travailleurs. L'ouvrage est conçu comme un libre propos. Bien que l'analyse de l'auteur parte d'une réalité juridique belge, ses réflexions et conclusions paraissent facilement transposables vers d'autres systèmes juridiques européens. Le fait que toute sa démarche se situe sur le plan plus abstrait des principes, n'y est sans doute pas étranger...
