Après des décennies de croissance rapide du droit international de l'environnement, il est aujourd'hui crucial d'assurer l'effectivité et l'efficacité de cette branche du droit. Cela implique, entre autres, de garantir la flexibilité et la réactivité des instruments existants. Cette thèse propose d'explorer les mécanismes et phénomènes permettant aux régimes internationaux environnementaux de s'adapter aux évolutions scientifiques, politiques et juridiques en s'appuyant sur un cas d'étude précis : l'influence de la Plateforme intergouvernementale politique et scientifique pour la biodiversité et les services écosystémiques (IPBES) en Méditerranée. L'IPBES a été récemment établie afin de pallier l'inefficacité des politiques environnementales en matière de biodiversité. En partant du postulat du succès de cette plateforme, cette thèse expose les divers moyens juridiques d'influences dont celle-ci dispose dans la région. Nous verrons ainsi que l'expertise institutionnelle des régimes méditerranéens constitue une modalité d'influence directe tandis que les nombreux phénomènes de diffusion normative lui assurent une influence indirecte. La Méditerranée comporte à une échelle réduite tous les enjeux du droit international de l'environnement. Une telle étude permettra donc de mettre en lumière des aspects rarement étudiés de cette branche du droit.

Coastal and estuarine environments at the interface of terrestrial and marine areas are among the most productive in the world. However, since the beginning of the industrial era, these ecosystems have been subjected to strong anthropogenic pressures intensified from the second half of the 20th century, when there was a marked acceleration in the warming (climate change) of the continents, particularly at high latitudes. Coastal ecosystems are highly vulnerable to alteration of their physical, chemical and biological characteristics (marine intrusion, acidification of marine environments, changes in ecosystems, evolution and artificialization of the coastline, etc.).In contact with heavily populated areas, these environments are often the receptacle of a lot of chemical and biological pollution sources that significantly diminish their resilience. In this context of accelerated evolution and degradation of these areas important for food security of many populations around the world, it is necessary to better identify the factors of pressure and understand, at different scales of observation, their effects and impacts on the biodiversity and on the socio-eco-systems, in order to determine the degree of vulnerability of these coastal ecosystems and the risks they face. A transdisciplinary and integrated approach is required to prevent risks. Within this framework, operational coastal oceanography occupies an important place but also the implementation of a true socio-eco-system approach in order to set up an environmentally friendly development.

The book focuses on the interactions between international legal regimes related to biodiversity governance. It addresses the systemic challenges by analyzing the legal interactions between international biodiversity law and related international law applicable to economic activities, as well as issues related to the governance of biodiversity based on functional, normative, and geographic dimensions, in order to present a crosscutting, holistic approach. The global COVID-19 pandemic, the imminent revision of the Strategic Plan for Biodiversity 2011-2020, and the Aichi Targets have created the momentum to focus on the interactions between the Convention on Biological Diversity and other international environmental regimes. Firstly, it discusses the principles that inspire biodiversity-related conventional law, the soft law that conveys targets for enforcement of the Biodiversity Convention, their structural, regulatory and implementation gaps, the systemic relations arising from national interests, and the role of scientific advisory bodies in biodiversity-related agreements. The second part then addresses interactions in specific conventional frameworks, such as the law of multilateral trade and global public health, and the participation of communities in the management of genetic resources. Lastly, the third part illustrates these issues using four case studies focusing on the challenges for sustainability and marine biodiversity in small islands, the Arctic Ocean, the Caribbean Sea, and the Mediterranean Sea, as a way to strengthen a horizontal and joint approach. This book provides a comprehensive understanding of environmental regionalism at the international level, analyzing the concept and identifying recurring patterns from six in-depth case studies. While ecoregions or environmental regions are defined on ecological boundaries rather than administrative criteria, ecoregionalism is the idea that regional dynamics should cluster around ecoregions, while ecoregionalization is the tendency of regional dynamics to cluster around ecoregions. Focusing on the international level, this book presents six cases of ecoregional processes from around the world and the regional environmental agreements: two are terrestrial, the Alps and the Andes; two are marine, the Mediterranean Sea and the Baltic Sea; two are related to freshwater ecosystems: the Amu Darya in Central Asia and the Great Lakes in North America. The book analyzes both ecoregional processes focused on the environment, as well as intersectoral ecoregional processes. The case studies are analyzed based on the ecoregional governance framework, developed by the author for this book.
