La reconstruction post-conflit est rarement associée aux problématiques concernant la protection du patrimoine culturel. En effet, dans l'imaginaire collectif, c'est plutôt la guerre qui est liée à l'idée de destruction délibérée des biens culturels, élément qui caractérise d'ailleurs les conflits ethniques et religieux contemporains. Constatant la privation de repères subie par certains groupes sociaux, nous nous demandons quel sort est réservé aux biens culturels à l'issue du conflit, car la mauvaise gestion de la reconstruction peut comporter des bouleversements importants pour les populations qui la subissent. Or, l'étude des normes protégeant les biens culturels montre que, contrairement au cadre juridique applicable aux conflits, le cadre prévalant en temps de paix est principalement constitué d'instruments de soft-law et ne prévoit aucun moyen de mise en œuvre. Devant une telle constatation, il est opportun de se demander si ce cadre peut toujours assurer la protection des biens culturels dans un contexte aussi complexe que celui d'une reconstitution postérieur à un conflit ethnique. L'étude de deux reconstruction récentes, le Liban et l'ex-Yougoslavie, permet de répondre à notre question. Si cette étude confirme d'une part cette carence, elle démontre d'autre part que les accords de paix peuvent, dans certains cas, pallier ces lacunes en offrant à l'UNESCO un moyen de contrainte juridique pour faire appliquer ses recommandations. Suite à ces expériences l'Organisation a d'ailleurs récemment orienté son activité normative et opérationnelle vers la répression de la destruction intentionnelle de biens culturels en temps de paix et vers la protection du patrimoine dans les contextes pré- et post-conflictuels.
