Excerpt from Legal Problems in the Housing Field: Public Housing Legal Problems; Legal Aspects of Public Housing The general business depression which dominated American life following the boom years of 1926 - 29 was characterized by a cessation of residential building activities along with the decline of other business. Attempts were made from 1931 on to produce more healthy conditions, so that a revival might come about. Private industry alone, Government alone, and Govern ment and industry together - all have attempted to raise the volume of home construction. All these efforts have resulted in progress but still fall far short of actually producing the number of new houses needed. The National Resources Committee has been thrown in contact with these problems from time to time in connection with various studies.1 During 1936 - 37 the Committee felt the necessity for securing more detailed information concerning a number of phases of the prob lems closely related to housing. Technicians in the various branches of the Government were asked to present monographs touching these particular problems. Naturally the men who prepared these documents drew on their own experience and presented their personal views which in no way represent the opinions Of the agencies with which they are connected. The Idea of Home in Law: Displacement and Dispossession explores an important set of legal and policy issues surrounding the concepts of home and homelessness, taking a growing area of legal scholarship into the new arena of human rights and international law. The collection considers the ideas concerning home - both in the sense of the dwelling place as a special type of property, and territorial claims to homeland - which underpin many contemporary legal problems, by examining a range of contexts where people are displaced or dispossessed from their homes. The essays focusing on dispossession consider themes ranging from mortgage and rent arrears in the UK to responses to the foreclosure crisis in the USA, and from eviction for the purposes of economic development in South Africa to the exclusion of asylum seekers from the UK's social housing and welfare provision, and within the framework of the European Convention on Human Rights. Title VIII of the Civil Rights Act of 1968, known as the Fair Housing Act, prohibited discrimination in the sale, rent, and financing of housing based on race, religion, and national origin. However, manifold historical and contemporary forces, driven by both governmental and private actors, have segregated these protected classes by denying them access to homeownership or housing options in high-performing neighborhoods. Perspectives on Fair Housing argues that meaningful government intervention continues to be required in order to achieve a housing market in which a person's background does not arbitrarily restrict access. The essays in this volume address how residential segregation did not emerge naturally from minority preference but rather how it was forced through legal, economic, social, and even violent measures. Contributors examine racial land use and zoning practices in the early 1900s in cities like Atlanta, Richmond, and Baltimore; the exclusionary effects of single-family zoning and its entanglement with racially motivated barriers to obtaining credit; and the continuing impact of mid-century "redlining" policies and practices on public and private investment levels in neighborhoods across American cities today. Perspectives on Fair Housing demonstrates that discrimination in the housing market results in unequal minority households that, in aggregate, diminish economic prosperity across the country. Amended several times to expand the protected classes to include gender, families with children, and people with disabilities, the FHA's power relies entirely on its consistent enforcement and on programs that further its goals.
