Under the Stability Pact Anti-corruption Initiative (SPAI), launched in Sarajevo in February 2000, regional governments, local and international civil society organisations, bilateral aid agencies and international organisations are combining their efforts to help curb corruption in South Eastern Europe. The SPAI follows a five pillar, multi-disciplinary process: 1) adopting and implementing relevant international legal instruments; 2) promoting good governance; 3) strengthening the rule of law; 4) promoting transparency and integrity in business operations; and 5) developing an active civil society. This report, which focuses on the fifth pillar of the Initiative, was adopted following the SPAI Conference on Civil Society on 17-19 September 2001 in Cavtat, Croatia and complements the SPAI general assessment report under pillars I-IV adopted in Tirana, Albania, in April 2001. It provides policymakers, legislators, businesses, civil society organisations and other stakeholders with an assessment of the legal and institutional environment in which civil society operates, together with recommendations for reform designed to enable civil society organisations, business associations, trade unions and the media to play a more active role in the fight against corruption. The report covers a wide range of issues including public attitudes, civil liberties, existing laws that facilitate the establishment of civil society organisations, freedom of the media, governmental transparency and co-operative partnerships between governments and civil society.

This second edition of State of Implementation of the United Nations Convention against Corruption: Criminalization, Law Enforcement and International Cooperation, which was launched during the 7th session of the Conference of the States Parties (Vienna, 6-10 November 2017).The study is based on the findings and results emanating from the first cycle reviews of the implementation of the Convention by 156 States parties (2010-2015). It contains a comprehensive analysis of the implementation of chapters III (Criminalization and law enforcement) and IV (International cooperation) of the Convention. Twenty-first-century constitutions now typically include a new 'fourth branch' of government, a group of institutions charged with protecting constitutional democracy, including electoral management bodies, anticorruption agencies, and ombuds offices. This book offers the first general theory of the fourth branch; in a world where governance is exercised through political parties, we cannot be confident that the traditional three branches are enough to preserve constitutional democracy. The fourth branch institutions can, by concentrating within themselves distinctive forms of expertise, deploy that expertise more effectively than the traditional branches are capable of doing. However, several case studies of anticorruption efforts, electoral management bodies, and audit bureaus show that the fourth branch institutions do not always succeed in protecting constitutional democracy, and indeed sometimes undermine it. The book concludes with some cautionary notes about placing too much hope in these – or, indeed, in any – institutions as the guarantors of constitutional democracy.
