L'octroi des privilèges à l'administration fiscale lui permettant de déterminer et recouvrer les recettes publiques, bien qu'il puisse être en principe justifié par des intérêts d'ordre public, peut conduire à l'entreprise d'actes arbitraires à l'encontre des contribuables. Ainsi, les citoyens sont appelés d'acquitter des sommes qu'il ne doivent pas et pour le recouvrement desquelles l'Etat peut utiliser des mesures forcées portant atteinte à leur liberté individuelle comme par exemple la contrainte par corps, leur crédibilité commerciale et leur propriété comme l'imposition d'une saisie à leur patrimoine mobilier ou immobilier.La question donc de la protection des citoyens contre l'administration devient cruciale. Tout d'abord, les contribuables peuvent se protéger contre les poursuites exercées à leur encontre par l'exercice d'une opposition dans le cadre du contentieux de recouvrement. La protection des contribuables est complétée à ce stade par la prévision d'une protection provisoire tendant la suspension des poursuites diligentées contre le contribuable. Ensuite, ils peuvent recourir à d'autres contentieux complémentaires au contentieux du recouvrement, à savoir l'action en responsabilité et l'action en restitution de l'indu. Enfin, à coté de la protection juridictionnelle offerte aux contribuables, sont prévues certains modes alternatifs de règlement des litiges fiscaux, comme d'un coté les accords transactionnels conclus entre les deux parties et de l'autre coté le recours à un tiers autre que la juridiction étatique, à savoir le tribunal arbitral, le médiateur ou un conciliateur.En concluant, on peut souligner la nécessité d'établissement de l'équilibre entre les contribuables et l'Etat, ce qui peut être effectué d'un coté avec la conformation du second aux principesconstitutionnels de l'égalité, de la capacité contributive des contribuables, du respect de leur propriété, du respect du principe de la proportionnalité et de l'octroi de la protection juridictionnelle aux citoyens, et de l'autre coté avec la consolidation de la conscience fiscale, qui apportera la conformation des contribuables à leur obligation d'acquitter les impôts dus.
