LE PRINCIPE DE SUBSIDIARITE EN DROIT COMMUNAUTAIRE

LE PRINCIPE DE SUBSIDIARITE EN DROIT COMMUNAUTAIRE PDF Author: FRANCOISE.. THOMA
Publisher:
ISBN:
Category : Central-local government relations
Languages : fr
Pages : 530

Book Description
LE PRINCIPE DE SUBSIDIARITE PREND SON ORIGINE DANS LA PHILOSOPHIE POLITIQUE ET DANS LA DOCTRINE SOCIALE DE L'EGLISE CATHOLIQUE. IL A ENSUITE PROGRESSIVEMENT CHEMINE VERS LE DROIT POSITIF POUR ETRE FORMALISE, D'UN POINT DE VUE JURIDIQUE, DANS L'ARTICLE 3B DU TRAITE SUR L'UNION EUROPEENNE. LA THESE ANALYSE COMMENT LE PRINCIPE DE SUBSIDIARITE S'EST CONCRETISE DANS LE DROIT COMMUNAUTAIRE, AU POINT D'EN DEVENIR UN PRINCIPE CONSTITUTIONNEL DE BASE. L'ANALYSE S'ATTACHE NOTAMMENT A LA QUESTION DE LA JUSTICIABLITE DU PRINCIPE DE SUBSIDIARITE, POUR CONCLURE QUE CE PRINCIPE JOUIT D'UNE JUSTICIABILITE MEDIATE, C'EST-A-DIRE EN RELATION AVEC UNE NORME MATERIELLE POSITIVE. QUANT AUX CONSEQUENCES DU PRINCIPE DE SUBSIDIARITE SUR LE PROJET D'INTEGRATION EUROPEENNE, ELLES SONT NOTAMMENT DE DEUX ORDRES : D'UNE PART, L'INSERTION DU PRINCIPE DE SUBSIDIARITE DANS LE DROIT POSITIF IMPLIQUE QU'IL FAUT REORIENTER L'INTERPRETATION DE LA PRIMAUTE ET DE LA PREEMPTION COMMUNAUTAIRE VERS UNE PRESOMPTION EN FAVEUR DE LA PLUS PETITE UNITE. DANS L'ABSENCE D'UNE LISTE EXPLICITE DE REPARTITION DES COMPETENCES ENTRE L'UNION ET LES ETATS MEMBRES, IL FAUT PARTIR DE L'HYPOTHESE QUE LES COMPETENCES ATTRIBUEES SONT EN PRINCIPE PARTAGEES ET QUE LES ETATS MEMBRES SONT PRESUMES REMPLIR LEURS FONCTIONS D'UNE FACON SUFFISANTE. LA COUR DE JUSTICE EST DEJA EN TRAIN D'INFLECHIR SA POSITION AUTREFOIS TRES PRO, COMMUNAUTAIRE, AINSI QUE PLUSIEURS EXEMPLES CONCRETS LE DEMONTRENT. D'AUTRE PART, L'INTRODUCTION DU PRINCIPE DE SUBSIDIARITE DANS LE DROIT POSITIF EST LE SIGNE D'UNE NOUVELLE INTERPRETATION DU 'FEDERALISME' EUROPEEN : L'INTEGRATION EUROPEENNE DEPASSE LES CATEGORIES JURIDIQUES TRADITIONNELLES. ELLE REPOSE SUR UNE REPARTITION FONCTIONNELLE, DYNAMIQUE ET FLEXIBLE DES COMPETENCES, QUI NE SONT JAMAIS ATTRIBUEES UNE FOIS POUR TOUTES, MAIS DONT L'EXERCICE PAR L'UN OU L'AUTRE NIVEAU S'ORGANISE EN CONTINUUM. LE NOUVEAU FEDERALISME REPOSE SUR L'ADHESION DES PEUPLES CONCERNES, QUI EXIGENT DESORMAIS QUE LE NIVEAU SUPERIEUR JUSTIFIE SES INTERVENTIONS.

The European Landscape Convention

The European Landscape Convention PDF Author: Michael Jones
Publisher: Springer Science & Business Media
ISBN: 9048199328
Category : Science
Languages : en
Pages : 327

Book Description
This important and insightful book provides, for the first time, a broad presentation of ongoing research into public participation in landscape conservation, management and planning, following the 2000 European Landscape Convention which came into force in 2004. The book examines both the theory of participation and what lessons can be learnt from specific European examples. It explores in what manner and to what extent the provisions for participation in the European Landscape Convention have been followed up and implemented. It also presents and compares different experiences of participation in selected countries from northern, southern, eastern and western Europe, and provides a critical examination of public participation in practice. However, while the book’s focus is necessarily on Europe, many of the conclusions drawn are of global relevance. The book provides a valuable reference for researchers and advanced students in landscape policies and management, as well as for professionals and others interested in land-use planning and environmental management.

National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law

National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law PDF Author: Anneli Albi
Publisher: Springer
ISBN: 9462652732
Category : Law
Languages : en
Pages : 1522

Book Description
This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.

Book Description
A uniquely important contribution to the debate on EC State aid, this book captures the direct knowledge and experience of twenty-six current and former Commission State aid litigators, offering detailed 'insider' analysis of EC State aid court cases, as well as related internal legal issues, between 1994 and 2008. The book brings together both legal and economic analysis, with detailed reflections on aspects of both substantive legal rules and procedural law. It also offers, over and above the specific interest of the contributions it contains, invaluable insights into the working methods of the Commission Legal Service. This collaborative work was conceived and realized by its authors as a mark of recognition, and a gesture of respect and friendship, for Francisco Santaolalla, on the occasion of his retirement from the Commission after fourteen years' service as Director of the State aid team. Among the many legal and economic forces affecting State aid litigation, the authors focus on such factors as the following:A {exports;A {private investment;A {role of economic analysis;A {ecotaxes;A {privatization;A {remedies;A {existing aid;A {third parties;A {actions against State aid decisions;A {national court decisions;A {fiscal discipline; andA {WTO subsidies law. In illuminating the underlying issues, and describing how they are handled by the Commission Legal Service, the authors shed light on the likely future development of State aid law. The book will be of particular interest to antitrust practitioners as well as academics
