Evolving Constitutions of International Organizations

Evolving Constitutions of International Organizations PDF Author: Sato
Publisher: Martinus Nijhoff Publishers
ISBN: 9004635300
Category : Law
Languages : en
Pages : 320

Book Description
This book analyzes the law-creating process relating to the interpretation of constituent instruments of international organizations. This topic is one of the key issues concerning the structures and activities of international organizations. It differs from other books in the field by suggesting that, under the influences of the inherent dynamism of international organizations, the interpretative framework of their constituent instruments is not the same as that of ordinary treaties. It also concludes that the interpretation of the constituent instruments of international organizations deviates from the interpretative framework regulated by the law of treaties as codified by the Vienna Convention on the Law of Treaties. The book will be of prime interest to academics in the fields of international law and international organization and treaty law.

Theory of International Law

Theory of International Law PDF Author: Robert Kolb
Publisher: Bloomsbury Publishing
ISBN: 1782258817
Category : Law
Languages : en
Pages : 511

Book Description
This book seeks to analyse various aspects of international law, the link being how they structure and marshal the different forces in the international legal order. It takes the following approaches to the matter. First, an attempt is made to determine the fundamental characteristics of international law, the forces that delineate and permeate its applications. Secondly, the multiple relations between law and policy are analysed. Politics are a highly relevant factor in the implementation of every legal order (and also a threat to it); this is all the more true in international law, where the two forces, law and politics, have significant links. Thirdly, the discussion focuses on a series of fundamental socio-legal notions: the common good, justice, legal security, reciprocity (plus equality and proportionality), liberty, ethics and social morality, and reason.

Book Description
The academic or scientific occupation with international relations is not always an encouraging task. At times one gets an image of the enormous psychic and physical forces which operate in the international realm, and it then seems that the role of the publicist is almost a negligible one. If one, in addition, arrives at the conclusion that human social action is not really a volitional process, then there is indeed ample room for pessimism and despair. Nevertheless, in the complexity of our consciousness, the different elements of which life is made of blend into a unity of which the idea is as much a part or even more so than the deed or action. The stress on action expresses the crudeness of our times but the idea has been much more the motivation of history and its cohesive force over long periods. Action in terms of force is never in itself the entire solution because it carries no conviction or understanding, at least unless its role is a very moderate one.
