Le problème de logement fortement ressenti en France ces dernières années a considérablement contribué au renforcement sans limite de la protection de l ́acquéreur immobilier par le législateur. Soucieux d ́une protection efficace, ce dernier est maintes fois intervenu par des lois importantes. Si le législateur a déjà manifesté sa volonté de protection par une loi du 3 janvier 1967 dans la vente d ́immeuble à construire, ce sont les lois du 13 juillet 1979 ( loi Scrivener), et du 31 décembre 1989 ( loi Neiertz) qui ont vraiment marqué les esprits. Les lois du 13 décembre 2000 (loi SRU) et du 13 juillet 2006 ( loi ENL) sont encore révélatrices. La stratégie de cette protection repose sur deux piliers essentiels : d ́une part le droit d ́information croissante dont bénéficie l ́acquéreur et d ́autre part le droit de repentir renforcé, un procédé efficace pour l ́acquéreur immobilier. Ce dernier en cas de recours à l ́emprunt se trouve également dans une situation confortable par le jeu de l ́interdépendance du contrat de vente et du contrat de prêt. La jurisprudence suit le même mouvement et la qualification des lois en lois de police est un moyen d ́y parvenir. La chambre mixte en date du 30 novembre 2007 n ́a pas hésité de qualifier la loi du 31 décembre 1975 en loi de police.

Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies.
