Apres une prise de conscience des pouvoirs publics sur les nouveaux risques pour la vie privee, les instruments specifiques sont toutefois apparus inadaptes a la societe de l'information. Le legislateur europeen a donc cherche a les faire evoluer, tout en respectant la liberte de circulation de l'information et en anticipant sur l'evolution rapide de l'outil numerique lato sensu. Si le legislateur europeen a eu cette volonte salutaire de s'attacher a la protection des donnees personnelles, tel n'est pas le cas de tous les Etats du monde entier pour qui la protection juridique de la vie privee peut apparaitre comme secondaire. Au regard de la circulation mondiale de l'information, cette absence d'unanimite est regrettable car elle fragilise les efforts entrepris par les Etats soucieux de proteger la vie privee. Dans un tel cas de figure et dans l'attente d'une acceleration de la prise de conscience, il faut alors compter sur des mecanismes ordinaires issus du droit international prive ou, en cas d'atteinte grave, sur ceux prescrits par le droit penal international. Toutefois, cette solution est loin d'etre ideale car elle subordonne la volonte judiciaire au bon vouloir des Etats.
