La reflexion sur les droits sociaux a ete, et continue d'etre, l'un des centres d'interet des recherches juridiques. Cette preoccupation pour les droit sociaux est revelatrice d'une tendance vers l'accueillement par les Etats de droit des demandes des plus demunis, notamment a travers des mecanismes d'exigibilite des droits sociaux en general, et du droit au logement en particulier, devant le juge. Le probleme remonte en fait aux anciennes discussions en matiere de definition des droits en regardant l'existence de l'action juridictionnelle pour l'exiger. En effet, les reponses se posaient dans les deux pays frequemment sur l'inexistence des moyens proceduraux pour assurer la protection de ce droit social. De telles difficultes sont logiquement liees a la notion de droit subjectif. La question qui traverse l'ensemble de cette etude est celle de savoir dans quelle mesure y a-t-il un veritable droit un logement en tant que droit-creance dans chaque ordonnancement juridique. Autrement dit, quel est le degre de permeabilite de chaque ordre juridique pour reconnaitre un droit au logement dans le sens d'un droit-prestation ?

This book deals with slums as a specific question and a central focus in urban planning. It radically reverses the official version of the history of world cities as narrated during decades: slums are not at the margin of the contemporary process of urbanization; they are an integral part of it. Taking slums as its central focus and regarding them as symptomatic of the ongoing transformations of the city, the book moves to the very heart of the problem in urban planning. The book presents 16 case studies that form the basis for a theory of the slum and a concrete development manual for the slum. The interdisciplinary approach to analysing slums presented in this volume enables researchers to look at social and economic dimensions as well as at the constructive and spatial aspects of slums. This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.
