En faisant apparaître le phénomène de diffusion de la confiance en droit général, il est possible de montrer que la confiance peut être une notion fondamentale du droit des contrats. La notion de confiance légitime sert ainsi de critère de qualification de la faute précontractuelle et de fondement à la force obligatoire du contrat. Le droit comparé permet de montrer que cette notion est utilisée tant par la doctrine que par la jurisprudence. Ainsi en est-il de la notion de reliance en droit anglais. En droit français, la notion de confiance entre en relation avec les principes de sécurité juridique et de prévisibilité. Le respect de ces principes permet l'instauration d'un climat de confiance. Dans une vision renouvelée du contrat, la notion de confiance traduit le passage d'une opposition d'intérêts entre les parties à l'établissement d'une véritable relation contractuelle entre partenaires. La prise en considération du comportement des contractants fait naître des devoirs de cohérence et de coopération. Dans cette nouvelle perspective, la notion de "contrat relationnel" met l'accent sur le souci d'assurer la pérennité du contrat afin d'instaurer entre les partenaires une conjecture de confiance. La notion de confiance participe ainsi d'un renouveau du paradigme du droit des contrats.
