A comparative analysis of the legislation in the field of bioethics in several Western countries, especially in European Union member states, shows that there is a profound difference both in legislative policies and in the ethical principles enshrined by the laws. Over the past few years bioethics, as a discipline, has attempted to elaborate individual and collective behavioural codes in several fields, but it has come up against enormous difficulties; it has not even been possible to reach a consensus between different countries on the general principles. An example of this is the recent Convention on Bioethics endorsed by the Council of Europe. The aim of the essays contained in this book is to highlight the differences between existing regulations in several countries, and to stress how necessary it is to elaborate a legal framework that could be shared by the widest range of national legislations. For there is no denying that technological advances in the fields of both biology and medicine, as well as progress in surgical treatments, mean that jurists the world over are faced with a common scientific reality. The task of the jurist must therefore be to engage in a comparative analysis so as to overcome the differences in national legislations.

Le consentement à l'acte médical constitue la pierre angulaire de la relation medecin-patient. Il est consacré par la loi du 29 juillet 1994, comme le sont les principes de l'inviolabilité du corps humain et de la dignité humaine. Il révèle l'existence d'un droit autonome du patient ; les deux principes précités ne permettent pas, à eux seuls, de service de fondement juridique à ce consentement. De cette analyse, il ressort que le principe du consentement du patient à l'acte médical présente une lisibilité accrue quant à son expression et a sa sanction. L'information médicale apparaît comme le préalable nécessaire à l'expression d'un consentement éclairé. Cette expression peut être dorénavant appréhendée au regard des règles relatives à la capacité juridique. En outre, considérer le consentement à l'acte médical comme une liberté publique simplifie les contentieux qui lui sont liés, notamment en ce qui concerne la nature du préjudice réparable. En vue d'améliorer les dispositions du droit français contemporain et compte tenu de la nouvelle lecture proposée quant au consentement du patient, il est suggèré l'insertion de nouveaux textes normatifs dans le code de la santé publique. Le droit international de la santé, s'il ne peut que partiellement être consideré comme un modèle, n'en demeure pas moins une référence utile, le droit français apparaissant comme une application particulière de ses dispositions. En revanche, quelques législations étrangères (canada, états-unis, Grande-Bretagne, suisse) offrent, par une démarche comparative, des solutions aisément transposables dans l'ordonnancement juridique français.
