Book Description
Since 2007 and the economic meltdown caused by the financial crisis, our societies have been evolving in different ways. New political movements have emerged in Southern Europe and new social movements in pursuit of common concerns are playing a more active role in our daily lives. In a parallel way, after the failure to predict the financial crisis, economist and social science researchers seek fresh thinking and new models that can better explain this new reality. Regulations are of critical importance in shaping the welfare of economies and society. Thus, core legal disciplines are exploring the effects of the financial crisis on social rights, labour market regulations, and civil, common law or international law, among others. With no doubt, the economic crisis has deeply impacted our economic, social, political and legal environment. During the last decade, researchers from a wide range of disciplines have been looking for solutions. Now it is time make a side stop on the way and to gather results. The 1rst International SBRLab Conference, Finding solutions for a post-crisis society, is organized by the Social and Business Research Lab (SBRLab), Universitat Rovira i Virgili. Collective Bargaining Developments in Times of Crisis

Collective Bargaining Developments in Times of Crisis PDF Author: Sylvaine Laulom
Publisher: Kluwer Law International B.V.
ISBN: 9041190279
Category : Law
Languages : en
Pages : 312

Book Description
In many EU Member States, the various economic crises of recent years provided grounds for a rarely equalled level of state intervention in the regulation of labour relations with an explicit aim: the decentralisation of collective bargaining. An extensive body of research – summed up and analysed expertly in the chapters of this very important book – reveals that the process of decentralisation has more often than not led to a situation where salaries and labour conditions are ever more frequently determined by direct negotiations between employer and employees, with the State becoming the sole guarantor of employee protection even as it encourages decreasing labour costs to ensure that companies remain competitive. The comparative approach offered in this book adds to this synthesis by providing examples of speci c recent developments in fourteen Member States and Turkey. Among the numerous topics and issues that arise are the following: – ‘opt-out’ clauses that derogate unfavourably from sectoral agreement standards; – extension of the employer’s unilateral decision-making power; – ‘memoranda of understanding’ imposed by the ‘troika’ (EU, ECB, and IMF); and – ‘stand-by arrangements’ imposed by the IMF. However, notwithstanding the strong emphasis on changing the structure of collective agreements by shifting the centre of gravity closer to the company, research nds promise in the reconstituted support for sector-level agreements increasingly found among very small businesses, networked businesses, and work via digital platforms. This is the rst book to take stock of the current state of collective bargaining in Europe. It is an essential study for labour and employment law practitioners, and an exemplary analysis of immeasurable value to policymakers and academics in the eld.

Constitutional Framework of European Labour Law in Italy, France, Germany, Portugal and Spain

Constitutional Framework of European Labour Law in Italy, France, Germany, Portugal and Spain PDF Author: Luís Gonçalves da Silva
Publisher: Springer Nature
ISBN: 303145717X
Category : Law
Languages : en
Pages : 160

Book Description
The challenges that labour law currently faces are well known. The emergence of new forms of work and the growing importance of technology in the age of the Fourth Industrial Revolution are important tests of the resilience of this field of law and its function: regulating the labour market. Therefore, it is becoming increasingly important to examine the fundamentals of labour law, especially how subordinate labour is addressed in various countries’ constitutions, in order to focus the analysis of the new phenomena affecting labour relations on their fundamental frameworks. In this context, this book puts forward an overarching framework that reflects how the Italian, German, French, Portuguese, and Spanish constitutions view labour in terms of both collective and individual relations – particularly the right to collective bargaining, the right to strikes and lock-outs, job security, and the right to remuneration – without losing sight of each Constitution's historical and political context. The aim of this book is therefore to provide an overview of the labour law frameworks in the constitutions of these legal systems and to show, by means of practical examples, how the law concretely implements them. Accordingly, it provides notes on the legal treatment of the topics analysed, serving as a practical guide for the study of these matters in the respective jurisdictions. This book will be of interest to all students and scholars of labour law looking for an overview of the topics covered in all five jurisdictions.

The Politics of Industrial Relations

The Politics of Industrial Relations PDF Author: Kerstin Hamann
Publisher: Routledge
ISBN: 1136652396
Category : Business & Economics
Languages : en
Pages : 320

Book Description
As unions in most other industrialized democracies continue to decline, unions in Spain have been able to regain and maintain strength despite unfavorable institutional, political, and economic conditions. The Politics of Industrial Relations provides a comprehensive analysis of Spanish unions from the Franco dictatorship until the present. It builds on industrial relations, comparative politics, and political economy literature to investigate the trajectory of Spanish unions. The book analyzes unions as political actors, that is, their interaction and involvement with governments, political parties, and nationwide policy-making processes to explain why Spanish unions appear in some ways as atypical in West European comparison. The development of Spanish unions and industrial relations is framed in a historical-institutionalist approach while also taking into account globalization and Europeanization processes. Using the case of the Spanish transition to democracy, the book demonstrates that the historical sequencing of institutional reforms in the political and industrial relations arenas holds significant and long-lasting consequences for the nature of unions and labor relations. The book concludes that by understanding unions as political actors, the history of Spanish unionism and industrial relations institutions is more easily accommodated than looking at unions as industrial actors alone. Comprehensive in its theoretical scope and empirical depth, The Politics of Industrial Relations presents Spain as an anomaly, and thus as a test case, for a multitude of theories developed in the political economy and industrial relations literatures.

Collective Bargaining, Discrimination, Social Security and European Integration

Collective Bargaining, Discrimination, Social Security and European Integration PDF Author: Roger Blanpain
Publisher:
ISBN:
Category : Law
Languages : en
Pages : 514

Book Description
Although nominally protected by a plethora of laws, and championed in several well-intentioned declarations and charters, today's worker often feels adrift on an uncharted sea subject to unpredictable currents that have nothing to do with the quality of his or her work. Can we get at the root of this serious problem? We can at least determine if our existing legal systems, especially in the area of collective bargaining, discrimination, social security and European integration are able and ready to tackle the world-of-work challenges that confront us. And if they are not, we can begin to formulate a basis for new and effective labour and social security laws. This was in fact the essential impetus for the European Conference of the International Society of Labour Law and Social Security held in Stockholm in September 2002, a ground-breaking conference of which this book is the written record. In general, the papers stress the European situation, as it is in the EU, both as it exists today and as it is likely to be in the foreseeable future, a community of twenty-five nations, that the major work challenges are felt, and that the legal debate on relevant issues is strongest and most open. However, the twenty-four distinguished authors include representatives from countries as far-flung as Belarus and Congo, Korea and Turkey, and with these contributions the analysis extends to a study of fundamental rights as they actually exist under a wide variety of labour and social security law regimes in today's world. Collective Bargaining, Discrimination, Social Security and European Integration should not be overlooked by any policymaker or academic in the fields of labour and industrial relations law or social security law. It is one of the most detailed and current investigations we have of a situation that threatens to become a crisis in contemporary law and society.
