Canada’s official languages legislation fundamentally altered the composition and operational considerations of federal institutions. With legislative change, Canada’s public service has achieved the equitable representation of its two official languages groups, provided services to the public in both official languages, and has codified rights for public servants to work in their official language of choice. On paper, the regime is robust. In practice, there is a persistent divergence between policy and practice, as English dominates as the regular language of work in the federal public service. Through an historical institutionalist lens based on extensive archival research and semi-structured interviews, Gaspard shows that the implementation of official languages policy in the federal public service from 1967–2013 could not challenge the predominance of English as the operating language of the federal public service. The analysis of the roles of actors, ideas and institutions that influenced the policy implementation process show that a lack of structural change, inadequate managerial engagement, and a false sense that both official languages are equally ingrained in the public service explain the persistence of English as the dominant language of work. Grâce aux modifications législatives, la fonction publique du Canada a réussi à mettre en place une représentation équitable de ses deux groupes de langues officielles, assure la prestation de services au public dans les deux langues officielles, et a procédé à la codification des droits des fonctionnaires de travailler dans la langue officielle de leur choix. En théorie, le régime est robuste. En pratique, il existe un fossé entre politique et pratique, l’anglais s’étant établi comme langue dominante de travail dans la fonction publique fédérale. En adoptant une approche historique à cette question institutionnelle et au moyen de recherches archivistiques et d’entrevues mi-structurées, Gaspard fait valoir que de 1967 à 2013, la mise en oeuvre du programme de langues officielles à la fonction publique fédérale n’a pu influer sur la trajectoire de l’anglais comme langue prépondérante de travail. L’analyse des rôles des intervenants et des institutions qui ont façonné le processus met en lumière le fait que l’absence de changements structurels, l’engagement insuffisant des gestionnaires, de même que la perception erronée que les langues officielles sont toutes deux bien ancrées dans la fonction publique se conjuguent pour expliquer la persistance de l’anglais comme principale langue de travail. The adoption of new regulations is planned for the spring of 2019.7 2 LANGUAGE OF WORK The second principle is the right of employees in federal institutions to work in the official language of their choice. [...] The public service employment rates for these communities vary with the mandate of the institution, the public served, the location of the offices and the categories of employment. [...] All federal institutions are subject to these four policy instruments, with the exception of the Senate, the House of Commons, the Library of Parliament, the Office of the Senate Ethics Officer, the Office of the Conflict of Interest and Ethics Commissioner and the Parliamentary Protective Service. [...] Since March 2009, the Official Languages Centre of Excellence - within the Office of the Chief Human Resources Officer of TBS - has coordinated the Official Languages Program in federal institutions that are subject to Parts IV, V and VI of the OLA. [...] According to a recent evaluation of the activities of the Official Languages Centre of Excellence, the three-year reporting approach raises concerns, because it does not provide a complete picture of the official languages situation or make it possible to compare results from one year to the next.47 That being said, the Auditor General of Canada reviewed the approach in spring 2015 and emphasized.

Language policies are political. They have political consequences as well as political origins. In State Traditions and Language Regimes, scholars from Asia, Europe, and North America shift focus from the consequences of language policies to how and why states make language policy choices. This shift, theorized through the concept of "language regime," inserts an urgently needed political science perspective into the current dialogue between sociolinguists, who research the societal effects of language policies, and political theorists of language rights, who analyze the normative implications of policies. New analytical tools drawn from comparative politics are showcased to analyze paths taken by different states in establishing language regimes, at times disrupted and redirected at critical junctures. Canada's official languages policy makes English and French the country's official languages in federal institutions. The policy has succeeded in fostering equitable representation of both official languages groups in the federal public service and has improved capacities for the public service to serve the citizenry in its official language of choice. It is a puzzle however, that despite these advances, the Canadian federal public service continues to operate predominantly in English when both official languages on paper are equal languages of work. To explore this puzzle this dissertation asks: why, despite the promise of the Official Languages Act (OLA) 1969 for choice in language of work and the OLA 1988 that made the choice a claimable right, is there inequitable access to French as a language of work in the federal public service? Framed through a historical institutionalist approach and layering, this project analyzes the implementation of the official languages program in the federal public service from 1967-2013. This thesis argues that the implementation of the official languages program could not challenge the federal public service's path dependency to operate predominantly in English. By analyzing the roles of actors and institutions that influenced the process, this dissertation finds that lack of structural change, inadequate managerial engagement and a false sense that official languages are engrained in the public service, can explain the persistence of English as the dominant language of work.
