The Law of Compulsory Purchase and Compensation

The Law of Compulsory Purchase and Compensation PDF Author: Michael Barnes KC
Publisher: Bloomsbury Publishing
ISBN: 1849467528
Category : Law
Languages : en
Pages : 660

Book Description
This book is a statement of the current law of compulsory purchase of land and compensation for that purchase. It covers all major aspects of the procedure for the compulsory acquisition of land and deals in full detail with all aspects of the law of compensation for such an acquisition. The many and diverse statutory provisions are organised into a series of chapters containing all principles and rules and there is a full analysis and explanation of the leading authorities on the subject and the principles derived from those authorities without which the subject cannot be understood. The aim of the book is, not only to explain the statutory provisions and to organise the various possible claims for compensation into different heads, but also to explain and analyse the substantial body of case law which has built up, particularly in recent years, and the relationship between that body of law and the underlying statutory provisions. The book also attempts to explain the purpose of the statutory provisions and the reason for the rules that are derived from the authorities. Chapters of the book are devoted to the procedure for formulating and pursuing a claim for compensation and to the valuation principles which must be applied in advancing claims. An Appendix is provided by Mr Nicholas Eden FRICS, a leading valuer in the field, which contains examples of different types of compensation valuation with annotations as to how the valuations are prepared and built up. A further aim of the book is to provide, where possible, practical advice to public authorities and landowners involved in the process of compulsory purchase and compensation as well as to explain the legal principles.

Land Administration and Practice in Hong Kong

Land Administration and Practice in Hong Kong PDF Author: Roger Nissim
Publisher: Hong Kong University Press
ISBN: 9789622098480
Category : Architecture
Languages : en
Pages : 222

Book Description
Hong Kong is frequently acclaimed as being the most open and business user-friendly environment in the world. However, it is often forgotten or overlooked that this paragon of capitalism is founded, and indeed underpinned, by a socialist leasehold land tenure system. As the government is landlord to virtually all land, it plays a pivotal role in the administration of this scarce and therefore valuable resource. The purpose of this book is to explain both the historical development and the current practice of land administration.Since publication of the book in 1998, it has been welcomed by students and practitioners of surveying, architecture, planning and law, and also by the wider business and financial community. In this second edition, the text has been thoroughly updated and should continue to be equally useful and popular.

Land Administration and Practice in Hong Kong, Fifth Edition

Land Administration and Practice in Hong Kong, Fifth Edition PDF Author: Roger Nissim
Publisher: Hong Kong University Press
ISBN: 9888754068
Category : Business & Economics
Languages : en
Pages : 240

Book Description
The purpose of this book is to explain both the historical context and current practices of land administration in Hong Kong. Although Hong Kong has an open and business-friendly environment, it is underpinned by a socialist leasehold land tenure system. The government is landlord to virtually all land and so it plays a pivotal role in the administration of this scare, and therefore, valuable resource. As land administration is governed by private contract law rather than legislation, it is constantly evolving with the courts handing down significant decisions on a regular basis. Government practice has to respond to this, as well as the community’s concern on how best land can be administered. The fifth edition has some substantial and important updates which should continue to be useful to both students and practitioners of surveying, architecture, planning and law, as well as the wider business and financial community.

Lawyers who handle transnational matters will appreciate the clarifications of particular terminology and its application. Throughout the book, the treatment emphasizes the specific points at which constitutional law affects the interpretation of legal rules and procedure. Thorough coverage by a local expert fully describes the political system, the historical background, the role of treaties, legislation, jurisprudence, and administrative regulations. The discussion of the form and structure of government outlines its legal status, the jurisdiction and workings of the central state organs, the subdivisions of the state, its decentralized authorities, and concepts of citizenship. Special issues include the legal position of aliens, foreign relations, taxing and spending powers, emergency laws, the power of the military, and the constitutional relationship between church and state. Details are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for both practising and academic jurists. Taking Land

Taking Land PDF Author: Tsuyoshi Kotaka
Publisher: University of Hawaii Press
ISBN: 0824846362
Category : Law
Languages : en
Pages : 392

Book Description
The Asia-Pacific region with its rapid urbanization has generated an immediate need for both land use control and compulsory purchase by national and local governments. This book takes a comparative look at land use laws in ten Asia-Pacific countries (Australia, China, Hong Kong, Japan, Korea, Malaysia, New Zealand, Singapore, Taiwan, Thailand) as well as in the United States. A land use scholar from each country describes and analyzes compulsory land acquisition and the means through which property owners can seek compensation when government regulations or policies become so burdensome that they approach the effect of compulsory purchase. The book's major themes are land use control and eminent domain (compulsory purchase). Contributors examine land use control by focusing on land ownership, statutory framework, land use plans and planning, zoning, building regulations, courts and common law, and regulatory taking among the eleven countries. Sections on eminent domain cover the right of government to take or reclaim private property. General topics discussed include the source of authority (often a country's constitution), the public purpose and the extent of power, compensation, due process, the importance of plans, the effect of a "colonial" legal system, and the accommodation of indigenous peoples' land rights. With the publication of this volume, legal scholars and practicing land use lawyers will be able to analyze and compare for the first time the individual legal approaches of developed and developing countries in the Asia-Pacific region. Contributors: David L. Callies, Li-Fu Chen, Anton Cooray, Glenys Godlovitch, Tsuyoshi Kotaka, Murray J. Raff, William J. M. Ricquier, Eathipol Srisawaluck, Won Woo Suh, Grace Xavier, Zhen Xian Bin.
