Un examen comparatif entre le droit français et le droit québécois montre que le droit français n'accorde pas autant d'importance à la protection de l'enfant qu'à ses droits. Les possibilités du mineur d'accéder à la justice, en dehors des procédures spécifiques telles que l'assistance éducative ou les procédures pénales, sont encore limitées.
