Or, celui-ci se développe dans tout le système juridique et le droit d'auteur ne peut l'ignorer, d'autant que le droit à l'information contribue à donner une nouvelle définition du public. L'on comprend rapidement la relation complexe et conflictuelle entre les deux concepts, l'un prônant la liberté alors que l'autre engendre des situations de monopoles. Il est donc nécessaire de rechercher un équilibre pour que le droit à l'information comme le droit d'auteur puissent être satisfaits. Cette recherche s'effectuera d'abord sous l'angle du droit d'auteur en tentant de résoudre le conflit avec les instruments connus par celui-ci. Or, cette recherche s'avérant insatisfaisante, il conviendra de l'effectuer sous l'angle du droit à l'information qui se révèlera être beaucoup plus satisfaisante.
