Cet ouvrage est le fruit d'une réflexion collective de juristes issus de différentes branches du droit. Il offre des analyses critiques croisées sur la mise en oeuvre, dans une perspective nationale et internationale, de la Charte des droits fondamentaux de l'Union européenne, qui a acquis une force contraignante en 2009. D'une manière générale, les effets de la Charte se font sentir non seulement dans l'ancrage de ses principes dans les constitutions et les législations nationales des Etats membres de l'Union européenne, mais également dans les décisions des juges à tous les niveaux de juridiction. Ces principes concernent des enjeux de société très débattus, tels que les questions relatives aux travailleurs détachés, à l'euthanasie, à la protection des données personnelles, au droit d'asile et au droit des étrangers, indépendamment des questions plus techniques ayant trait aux garanties procédurales. Cette étude transversale a pour ambition de livrer un premier bilan sur l'effectivité de la protection des droits et libertés proclamés dans un texte auquel se réfèrent de manière croissante autant les juges européens que les juges nationaux pour fonder leurs décisions. Elle vise ainsi à éclairer les différents acteurs de la scène des droits de l'homme en Europe : les institutions européennes, les Etats, les juridictions et, plus généralement, les justiciables. L'ouvrage ne s'adresse pas uniquement aux initiés (universitaires et juristes professionnels), mais également à un public plus large (militants associatifs et d'ONG, étudiants et citoyens) sensible à la protection des droits et des libertés. Cette protection est en effet au coeur des valeurs qui fondent la construction européenne, dont la Charte est l'expression.
