Un acte médical ou de soin, ne peut être effectué que par un professionnel compétent c'est-à-dire ayant acquis la possibilité de pratiquer cet acte par l'obtention de son diplôme. Cependant, en maternité, il arrive que certains actes soient délégués à d'autres professionnels n'ayant pas les compétences, au sens de la loi, pour les effectuer. Pourquoi les sages-femmes délèguent des actes pouvant engager leur responsabilité médico-légale ? Les hypothèses avancées pour répondre à cet objectif ont été que les sages-femmes manquent d'informations sur les actes pouvant être réalisés par chacun des professionnels de leur équipe, mais aussi qu'elles sont insuffisamment informées sur les différents types de responsabilités juridiques de leur profession en cas de plainte. Pour répondre à cette problématique, une étude par questionnaires comportant des questions à choix multiples et des vignettes cliniques a été menée dans plusieurs maternités d'île de France Les résultats ont montré qu'aucune sage-femme ne connait exactement le champ de compétences des infirmières, auxiliaires de puériculture ou aide-soignante. De même, les sages-femmes ont conscience qu'il existe un risque pour elles dans certaines situations mais ne savent pas l'identifier et évaluer ses implications.

The concept of madness as a challenge to communities lies at the core of legal sources. Medieval Communities and the Mad: Narratives of Crime and Mental Illness in Late Medieval France considers how communal networks, ranging from the locale to the realm, responded to people who were considered mad. The madness of individuals played a role in engaging communities with legal mechanisms and proto-national identity constructs, as petitioners sought the king's mercy as an alternative to local justice. The resulting narratives about the mentally ill in late medieval France constructed madness as an inability to live according to communal rules. Although such texts defined madness through acts that threatened social bonds, those ties were reaffirmed through the medium of the remission letter. The composers of the letters presented madness as a communal concern, situating the mad within the household, where care could be provided. Those considered mad were usually not expelled but integrated, often through pilgrimage, surveillance, or chains, into their kin and communal relationships.
