Fondée sur une conception stricte, essentiellement matérielle de l'ordre public, à la fois préventive et curative, elle tend à préserver, en imposant à chacun une discipline minimale, le respect et la conciliation des libertés de tous et concourt à l'équilibre social. Principe politique, la police administrative entretient également des liens étroits avec le droit : c'est la règle de droit qui en fonde l'existence, en précise les conditions d'exercice et en fixe les limites, et s'il faut se garder de toute appréhension par trop contentieuse de la question, la compréhension de la police administrative ne saurait être complète sans une approche juridique. En dépit de l'intérêt relatif qu'elle suscite de la part de la doctrine, elle occupe ainsi une place de choix dans le droit administratif, quand bien même elle ne tend pas à se fondre, à présent, dans l'ensemble quelque peu imprécis du "droit de la sécurité intérieure", voire du "droit de la sécurité". S'il est vrai que le droit positif est aujourd'hui foisonnant, et que la jurisprudence s'avère parfois imprécise, voire teintée de subjectivisme, la police administrative n'en procède pas moins, en définitive, d'un ensemble de principes directeurs qui lui donnent consistance et stabilité. C'est à l'examen et à la mise en perspective de ces derniers que s'attache cet ouvrage, à l'aide d'exemples tirés de la loi, de la jurisprudence et de la doctrine, voire de la pratique administrative, offrant ainsi au lecteur une synthèse d'ensemble d'une matière plus subtile qu'une première approche ne le laisse parfois supposer.

This book offers a global history of civilian, military and gendarmerie-style policing around the First World War. Whilst many aspects of the Great War have been revisited in light of the centenary, and in spite of the recent growth of modern policing history, the role and fate of police forces in the conflict has been largely forgotten. Yet the war affected all European and extra-European police forces. Despite their diversity, all were confronted with transnational factors and forms of disorder, and suffered generally from mass-conscription. During the conflict, societies and states were faced with a crisis situation of unprecedented magnitude with mass mechanised killing on the battle field, and starvation, occupation, destruction, and in some cases even revolution, on the home front. Based on a wide geographical and chronological scope – from the late nineteenth century to the interwar years – this collection of essays explores the policing of European belligerent countries, alongside their empires, and neutral countries. The book’s approach crosses traditional boundaries between neutral and belligerent nations, centres and peripheries, and frontline and rear areas. It focuses on the involvement and wartime transformations of these law-enforcement forces, thus highlighting underlying changes in police organisation, identity and practices across this period.
