El trabajo de investigación elabora inicialmente dos hipótesis de investigación. La primera relacionada con el problema de las fuentes de la fuerza normativa de la Constitución. Y, la segunda, con el problema de los medios o instrumentos que garantizan la reproducción democrática del sistema constitucional. Conforme al primer problema, la tesis elaborada dice: que la fuerza normativa de la Constitución tiene como fuente la voluntad racional de los destinatarios que estos otorgan en condiciones de libertad. Y, conforme a la segunda, la tesis elaborada dice: que es la participación política y social en condiciones de igualdad de los individuos en el sistema político el medio que garantiza el desarrollo democrático del sistema constitucional. Resultando ambas hipótesis verdaderas, a la luz de la aplicación de la teoría contemporánea del discurso racional, la nueva hipótesis se afinca en el problema acerca de las posibilidades de su aplicación en un sistema estatal caracterizado por la clausura de los canales de participación sociales y políticos, como es el caso vigente en México. Las hipótesis serán de ahora en adelante, en primer lugar, que la Justicia constitucional, en aquel marco histórico, constituye la última garantía contra la clausura democrática del sistema político; y, en segundo lugar, que la interpretación que considera a la Constitución como una norma que tutela el proceso democrático refuerza en un sentido positivo la labor de la Jurisdiccional constitucional, en su labor de garantía constitucional contra la clausura antidemocrática del sistema. La Jurisdicción constitucional como garante contra la clausura democrática del sistema, tiene como deber garantizar la apertura de los canales de participación política de toda la ciudadanía y, sobre todo, garantizar que los grupos más desfavorecidos no resulten afectados, en ningún caso, por decisiones políticas o jurídicas que, ya sea directa o indirectamente, mermen su capacidad de participación en el sistema estatal.

This book examines the reasoning practice of 15 constitutional courts and supreme courts, including the Caribbean Commonwealth and the Inter-American Court of Human Rights. Enriched by empirical data, with which it strives to contribute to a constructive and well-informed debate, the volume analyses how Latin American courts justify their decisions. Based on original data and a region-specific methodology, the book provides a systematic analysis utilising more than 600 leading cases. It shows which interpretive methods and concepts are most favoured by Latin American courts, and which courts were the most prolific in their reasoning activities. The volume traces the features of judicial dialogue on a regional and sub-regional level and enables the evaluation and comparison of each country's reasoning culture in different epochs. The collection includes several graphs to visualise the changes and tendencies of the reasoning practices throughout time in the region, based on information gathered from the dataset. To better understand the current functioning and the future tendencies of courts in Latin America and the Caribbean, the volume illuminates how constitutional and supreme courts have actually been making their decisions in the selected landmark cases, which could also contribute to future successful litigation strategies for both national constitutional courts and the Inter-American Court for Human Rights.
