En réponse aux limites du règlement des différends liés à la dette publique et au corpus juridique international sous-développé qui en résulte sur les défauts souverains, les créanciers ont déposé un nombre croissant d'arbitrages entre investisseurs et États pour recouvrer les dettes impayées, suscitant une pluie de critiques et d'inquiétudes. Cette thèse de doctorat présente une voie encore inexplorée de résolution des créances souveraines : la médiation. L'auteur explique en quoi la médiation diffère en tant que processus du litige judiciaire et de l'arbitrage privé, produisant des résultats très distincts. Elle explorera ensuite comment la médiation peut être appliquée pour résoudre les différends liés à la dette souveraine en particulier. Plus précisément, la thèse portera sur la manière dont la médiation pourrait être introduite dans le processus de règlement des différends en cas de défaut souverain, soit en tant qu'accord préenregistré de médiation dans les instruments financiers pertinents ou les accords d'investissement internationaux, soit en tant qu'accord ultérieur direct entre créanciers et souverains. . Il examinera ensuite le potentiel de la médiation à produire des accords volontaires entre les créanciers et les souverains sur le remboursement des dettes d'une manière efficace en termes de coûts et de temps qui pourraient soutenir la reprise économique et la poursuite des investissements.

The first two decades of the twenty-first century witnessed a series of large-scale sovereign defaults and debt restructurings, in which sovereigns struggled to negotiate with recalcitrant bondholders, particularly hedge funds. Also, the outbreak of the COVID-19 pandemic in 2020 heralded a bleak financial outlook for many developing and emerging market countries, requiring sovereign debt restructuring in times of great macroeconomic uncertainty. Given the absence of a multilateral mechanism for sovereign debt restructuring equivalent to domestic corporate bankruptcy system, however, defaulted sovereigns often suffer from holdout litigation wrought by bondholders. This book proposes ways in which such legal actions could be regulated without the undue expense of bondholders' remedies by exploring the mechanism of balancing bondholder protection and respect for sovereign debt restructuring at various stages of litigation and arbitration proceedings.
