Cette thèse étudie les imbrications de la technologie informatique sur le concept d'"oeuvre de l'esprit", objet de la protection par le droit d'auteur. La création générée par ordinateur est le résultat final d'un traitement par machine et en même temps un mode d'expression récent pour produire des oeuvres. La création nouvelle mérite-t-elle protection ? Si oui, comment ? La démarche de qualification s'organise. Le premier chapitre entreprend de démontrer l'autonomie du résultat généré par rapport à son logiciel de création. Le second tente une assimilation de la création générée par ordinateur aux catégories légales nommées et fait une application de la règle d'égalité des oeuvres protégées. Le volet suivant définit l'oeuvre nouvelle en fonction du domaine matériel protégé par le droit. Le dernier, enfin, fait de la qualité déterminante de l'originalité en droit d'auteur, un critère opérationnel permettant de satisfaire cet indispensable besoin de protection. En cela, la création générée par ordinateur nécessite une objectivation de l'ensemble des signes de reconnaissance classique de l'oeuvre protégée par le droit d'auteur. Elle justifie que soit organisé le détail de la protection car l'influence car l'influence de l'ordinateur dans la créativité est mesurable.

The view of translation as a socially regulated activity has opened up a broad field of research in the last few years. This volume deals with central questions of the new domain and aims to contribute to the conceptualisation of a general sociology of translation. Interdisciplinary in approach, it discusses the role of major representatives of sociology like Pierre Bourdieu, Bruno Latour, Bernard Lahire, Anthony Giddens or Niklas Luhmann in establishing a theoretical framework for a sociology of translation.
