Questo volume raccoglie le riflessioni del convegno che si è svolto nell’Università degli Studi di Milano l’11 dicembre 2020, dedicato al ventennale della Carta dei diritti fondamentali dell’Unione europea. Un periodo di “vita” sufficientemente lungo da suggerire l’opportunità di fermare il momento e di tentare un bilancio sulla sua effettiva resa. Non una celebrazione fine a se stessa, ma la volontà di ragionare a fondo dell’impatto che la Carta di Nizza ha realmente avuto sul processo di integrazione europea. Per farlo abbiamo ritenuto importante che a ragionarne fossero studiosi afferenti a diversi ambiti disciplinari – a testimonianza della complessità della materia e della necessità di approcciarvisi con una visuale più ampia possibile – così come coloro che si interfacciano con la Carta nella pratica giudiziaria. Il confronto si è inoltre arricchito del contributo autorevolissimo di Giudici della Corte costituzionale (il Presidente Amato e il Vice Presidente Zanon) e della Corte di Giustizia (il Vice Presidente emerito Tizzano), ai quali sentiamo di rivolgere un particolare ringraziamento. I saggi raccolti in questo volume cercano di rispondere, senza certo pretesa di esaurire il discorso, a domande cruciali, che attengono alla natura, agli effetti, ai confini di applicabilità e al “destino” stesso della Carta; non isolatamente intesa, naturalmente, ma nelle interazioni che questo catalogo di diritti intrattiene, per il tramite degli operatori che ne applicano ed interpretano le previsioni, con le costituzioni nazionali e con la Convenzione per la salvaguardia dell’uomo e delle libertà fondamentali.

Work is constantly reshaped by technological progress. New ways of production are adopted, markets expand, and societies evolve. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Sovereignty marks the boundary between politics and law. Highlighting the legal context of politics and the political context of law, it thus contributes to the internal dynamics of both political and legal systems. Constitutional pluralism has become immensely popular among scholars who study European integration and issues of global governance. Some of them believe that constitutionalism, traditionally thought to be bound to a nation state, can emerge beyond state borders - most importantly in the process of European integration, but also beyond that, for example, in international regulatory regimes such as the WTO, or international systems of fundamental rights protection, such as the European Convention. At the same time, the idea of constitutional pluralism has not gone unchallenged. Some have questioned its compatibility with the very nature of law and the values which law brings to constitutionalism. The critiques have come from both sides: from those who believe in the 'traditional' European constitutionalism based on a hierarchically superior authority of the European Union as well as from scholars focusing on constitutions of particular states. The book collects contributions taking opposing perspectives on constitutional pluralism - some defending and promoting the concept of constitutional pluralism, some criticising and opposing it. While some authors can be called 'the founding fathers of constitutional pluralism', others are young academics who have recently entered the field.
