One L

One L PDF Author: Scott Turow
Publisher: Farrar, Straus and Giroux
ISBN: 1429939567
Category : Biography & Autobiography
Languages : en
Pages : 336

Book Description
One L, Scott Turow's journal of his first year at law school and a best-seller when it was first published in 1977, has gone on to become a virtual bible for prospective law students. Not only does it introduce with remarkable clarity the ideas and issues that are the stuff of legal education; it brings alive the anxiety and competiveness--with others and, even more, with oneself--that set the tone in this crucible of character building. Each September, a new crop of students enter Harvard Law School to begin an intense, often grueling, sometimes harrowing year of introduction to the law. Turow's group of One Ls are fresh, bright, ambitious, and more than a little daunting. Even more impressive are the faculty. Will the One Ls survive? Will they excel? Will they make the Law Review, the outward and visible sign of success in this ultra-conservative microcosm? With remarkable insight into both his fellows and himself, Turow leads us through the ups and downs, the small triumphs and tragedies of the year, in an absorbing and thought-provoking narrative that teaches the reader not only about law school and the law but about the human beings who make them what they are. In the new afterword for this edition of One L, the author looks back on law school from the perspective of ten years' work as a lawyer and offers some suggestions for reforming legal education.

Foundations of Law

Foundations of Law PDF Author: Adam J. MacLeod
Publisher: Ingram
ISBN: 9781531004637
Category : Jurisprudence
Languages : en
Pages : 0

Book Description
Foundations of Law is designed to help law and pre-law students make sense of law in a changeful age. It is founded upon the conviction of the English jurist William Blackstone that students who intend to study law need both technical instruction in law and liberal education in the history and jurisprudential concepts of law. The book considers the enduring nature of law and its relationship to equity and justice with the assistance of the authors of what we today call the Great Books. It also emphasizes enduring aspects of legal practice: the role of logic; the meaning and importance of conscience and of due process; different approaches to textual interpretation; and the relation of law to other normative concepts (such as morality and religion) and to science (such as economics). The book surveys classic writings concerning law and justice--for example, the works of Sophocles, Plato, Aristotle, and Aquinas. It contains writings that are foundational to Anglo-American legal norms and institutions--Blackstone, Bentham, Locke, the Federalists, Lincoln, Holmes, and others. It includes helpful analytical insights from influential jurisprudence scholars--Austin, Hart, Hohfeld, Dworkin, and Finnis, among others. Most uniquely, it matches each of those writings with constitutions, declarations, statutes, judicial decisions, and other legal and political texts (even a letter from jail) that illustrate and reinforce the key lessons drawn from the great works. The book does not leave students adrift in abstractions. It provides a solid grounding for understanding and practicing law in a rapidly-changing world. Combines technical instruction in law with liberal education in the history and jurisprudential concepts of law. Provides a solid grounding in the enduring characteristics of law to enable students to understand and practice law in a rapidly-changing world. Surveys the great books concerning law, equity, and justice. Uniquely matches each great book excerpt with judicial decisions, statutes, proclamations, and other legal materials to illustrate how foundational concepts recur in contemporary legal norms and institutions and to illustrate and reinforce the key lessons drawn from the great works. Emphasizes enduring aspects of legal practice: the role of logic; the meaning and importance of conscience and of due process; different approaches to textual interpretation; and the relation of law to other normative concepts (such as morality and religion) and to science (such as economics). Includes helpful analytical insights from influential jurisprudence scholars--Austin, Hart, Hohfeld, Dworkin, and Finnis, among others. Opens each chapter with reading questions to assist beginning students. Follows readings with notes to direct more advanced students to additional reading and further lines of inquiry.

"L’être situé", Effectiveness and Purposes of International Law

Author: Shotaro Hamamoto
Publisher: BRILL
ISBN: 9004294287
Category : Law
Languages : en
Pages : 319

Book Description
The traditional and mainstream conception of international law presupposes a certain ideal type of State. However, each State is situated in a particular context – an Etat situé – and the universal, impartial and non-discriminatory application of international law to each State often produces unjustifiable results in the real world. International law thus needs to cope with this existential question in order to ensure and maintain the effectiveness of the international legal order, without, however, being trapped by a nihilistic relativism. This approach requires a flexible understanding and reconstruction of the international law-making theory. The present collection of essays gathers contributions written in honour of Professor Ryuichi Ida by his colleagues and former students, inspired by the dédicataire, who places particular emphasis upon the context, effectiveness and purposes of international law. The dédicataire’s perspective finds wide ranging applications and the present collection deals with international economic law, international criminal law, international environmental law, international law-making, the law of State responsibility and the law of international organizations. Contributors are: Tatsuya Abe, Pierre-Marie Dupuy, Shotaro Hamamoto, Machiko Kanetake, Tomohiko Kobayashi, Tomonori Mizushima, Hironobu Sakai, Akiho Shibata, Mari Takeuchi, Dai Tamada, Sakda Thanitcul, Zhi-an Wang, and Takuhei Yamada.

Praise for volume 1: "[...] The authors have taken advantage of the retrospection inherent in this volume to provide perspective that may not be available in the instant commentaries. Thus, the bilingual volume will be useful both to readers needing a quick summary of a WTO decision and to specialists seeking to trace through the development of the rapidly evolving WTO jurisprudence." - Steve Charnovitz, in: The American Journal of International Law, Volume 98

Book Description
WTO, OMC, these abbreviations are now well known throughout the world and the organization contained in these three-letter acronyms has become a principal actor in international relations – economic and other. Everyone knows that a large part of its impact in international society comes from a revolutionary dispute settlement mechanism (DSM) that forms part of the World Trade Organization. More than 330 claims have been deposited in ten years, of which 115 led to reports of ad hoc panels and more than half of those led to a report of the Appellate Body. This bilingual volume is only the fourth volume in a series, which has the ambition to present the “jurisprudence” of this new mechanism, in a simple, coherent and systematic fashion. It is the result of intense cooperation between the two editors, and it is hoped to become a major reference work for all interested in the jurisprudence of the WTO and more generally in the regulation of economic relations with respect to international trade and all its multiple implications on the daily life of everyone.
