Quelles sont les relations qu'entretiennent le droit des Nations unies et le droit international? Ces ensembles normatifs constituent-ils deux ordres juridiques distincts? Une réponse affirmative à cette dernière question est indispensable si l'on veut analyser l'influence du droit des Nations unies sur le droit international. La thèse défendue ici démontre que le droit des Nations unies, en tant que droit produit par une organisation internationale de dimension universelle, fait évoluer le droit international selon un modèle d'influence précis. Le droit de l'ONU a imposé au droit international un changement d'équilibre sans pour autant l'obliger à un changement de structure. Ce résultat est atteint par la consolidation puis la transformation du droit international sous l'influence du droit des Nations unies. Tout d'abord, le droit des Nations unies renforce l'autorité des principes fondamentaux du droit international, partageant ainsi avec lui des fondements communs, et utilise ses mécanismes institutionnels pour favoriser l'application du droit international. Ce faisant, il affirme une identité propre par rapport au droit international. Cette autonomisation du droit des Nations unies l'autorise ensuite à créer de nouvelles nonnes de droit international, obligeant en conséquence à repenser la' représentation de l'ordonnancement de l'ensemble des règles internationales. Ainsi, l'introduction du droit des Nations unies dans le droit international, il y a plus de soixante ans, a irrémédiablement changé l'organisation matérielle et formelle du système juridique international.

This book analyses the exercise of authority by the UN Security Council and its subsidiary organs over individuals. The UN Security Council was created in 1945 as an outcome of World War II under the predominant assumption that it exercises its authority against states. Under this assumption, the UN Security Council and those individuals were ‘distanced’ by the presence of member states that intermediate between the Security Council’s international commands and those individuals that are subject to member states’ domestic law. However, in practice, the UN Security Council’s exercise of authority has incrementally removed the presence of state intermediaries and reduced the Security Council’s distance to individuals. This book demonstrates that this phenomenon has increased the relevance of domestic law in developing the international normative frameworks governing the UN Security Council and its subsidiary organs in safeguarding the rights, obligations, and interests of those affected individuals. This book presents how the UN Security Council’s exercise of authority has been received at the domestic level, and what would be the international implications of the Security Council’s extensive encounter with the actors who primarily reside in a domestic legal order.
