International Perspectives on Disability Exceptions in Copyright Law and the Visual Arts PDF Author: Jani McCutcheon
Publisher: Routledge
ISBN: 1000193551
Category : Art
Languages : en
Pages : 268

Book Description
This book provides an overview of disability exceptions to copyright infringement and the international and human rights legal framework for disability rights and exceptions. The focus is on those exceptions as they apply to visual art, while the book presents a comprehensive study of copyright’s disability exceptions per se and the international and human rights law framework in which they are situated. 3D printing now allows people with a visual impairment to experience 3D reproductions of paintings, drawings and photographs through touch. At the same time, the uncertain application of existing disability exceptions to these reproductions may generate concerns about legal risk, hampering sensory art projects and reducing inclusivity and equity in cultural engagement by people with a visual impairment. The work adopts an interdisciplinary approach, with contributions from diverse stakeholders, including persons with disabilities, cultural institutions and the 3D printing industry. The book sketches the scene relating to sensory art projects. Experts in intellectual property, human rights, disability and art law then critically analyse the current legal landscape relating to disability access to works of visual art at both international and regional levels, as well as across a broad representative sample of national jurisdictions, and identify where legal reform is required. This comparative analysis of the laws aims to better inform stakeholders of the applicable legal landscape, the legal risks and opportunities associated with sensory art and the opportunities for reform and best practice guidelines, with the overarching goal of facilitating international harmonisation of the law and enhanced inclusivity.

New Developments in EU and International Copyright Law

New Developments in EU and International Copyright Law PDF Author: Irini A. Stamatoudi
Publisher: Kluwer Law International B.V.
ISBN: 9041159991
Category : Law
Languages : en
Pages : 522

Book Description
More than a source of income and a means of protection for creators, rightholders, and the creative and entertainment industries, copyright is also a vehicle for technological advances and economic development. In the European Union, industries with intensive emphasis on intellectual property rights (mainly copyright) generate more than a quarter of employment and more than a third of economic activity. Yet copyright continues to be plagued by problematic attempts to balance the interests of rightholders, the public, consumers, intermediaries, collecting societies, different national legal traditions, and other forces, European and global. This book draws a comprehensive picture of current, pending, and proposed copyright developments – legislation, ‘communications,’ white papers, and court decisions – at the levels of the European Union and the World Intellectual Property Organization. Twenty-two well-known and prestigious experts on intellectual property law from seventeen jurisdictions worldwide contribute essays on particular trends in copyright, including discussions of the following and more: - making content available in an EU digital single market; - collective management and multi-territorial licensing; - exceptions for libraries and archives, education and research; - traditional knowledge and cultural expressions; - unjustified geoblocking; - illegal content on the Internet; - text and data mining; - copyright enforcement online; and - role of the European Court of Justice. Policy recommendations are also set forth, as well as a detailed conceptual framework for a potential EU Copyright Code. As a detailed and thoughtful overview of current trends in copyright internationally, this book has no peers. It is sure to be welcomed by practitioners, policymakers, academics, researchers, and business leaders for whom intellectual property rights, and especially copyright, are of the first importance.

The Routledge Handbook of Disability Arts, Culture, and Media

The Routledge Handbook of Disability Arts, Culture, and Media PDF Author: Bree Hadley
Publisher: Routledge
ISBN: 1351254669
Category : Performing Arts
Languages : en
Pages : 402

Book Description
In the last 30 years, a distinctive intersection between disability studies – including disability rights advocacy, disability rights activism, and disability law – and disability arts, culture, and media studies has developed. The two fields have worked in tandem to offer critique of representations of disability in dominant cultural systems, institutions, discourses, and architecture, and develop provocative new representations of what it means to be disabled. Divided into 5 sections: Disability, Identity, and Representation Inclusion, Wellbeing, and Whole-of-life Experience Access, Artistry, and Audiences Practices, Politics and the Public Sphere Activism, Adaptation, and Alternative Futures this handbook brings disability arts, disability culture, and disability media studies – traditionally treated separately in publications in the field to date – together for the first time. It provides scholars, graduate students, upper level undergraduate students, and others interested in the disability rights agenda with a broad-based, practical and accessible introduction to key debates in the field of disability art, culture, and media studies. An internationally recognised selection of authors from around the world come together to articulate the theories, issues, interests, and practices that have come to define the field. Most critically, this book includes commentaries that forecast the pressing present and future concerns for the field as scholars, advocates, activists, and artists work to make a more inclusive society a reality.

Artists' Rights

Artists' Rights PDF Author: Molly Torsen Stech
Publisher: Institute of Art and Law
ISBN: 9781903987292
Category : Copyright
Languages : en
Pages : 0

Book Description
This book provides an overview of various ways in which the spheres of art and copyright law come into contact with one another. While copyright laws are domestic in nature, the arts are increasingly international in scope, inspiration, and dissemination. The book highlights some of the challenges inherent in this overlap, ranging from definitional discrepancies between disciplines to circumstances that would benefit from more legal clarity - domestic or otherwise - to provide appropriate guidance to creators and to the organizations that display, sell, or otherwise use their artworks. The book confronts the challenges that are raised today, not only by digitization, but by new media of expression. As international art fairs proliferate, and as artists of all disciplines inspire and build from each other's works and ideas, the role of copyright in an artist's life can only become more important. Artists' Rights introduces artists to legal concepts in the intellectual property space that could become important tools in managing their artworks, now and into the future. [Subject: Art Law, Copyright Law, Intellectual Property Law]
