This is a most curious work as it offers an analysis that now seems frozen in amber. Drawing on the example of Le Fur's Etude sur la Guerre Hispano-Americaine de 1898, Envisagee au Point de Vue du Droit International Public (1899) and similar studies, Benton set out to provide an exploration of Spanish-American relations prior to and during the war. This work is critical, but it leans heavily toward a pro-American point of view. He concludes, for instance, that American military and diplomatic objectives were achieved to varying degrees, that at the end of the conflict Cuba was granted complete sovereignty, and that the treaty of peace was fulfilled. Most curiously for the modern scholar, he ends with the recognition that "the occasion of the recent intervention provided for in the Platt Amendment is outside the scope of this work" (291). Benton was a professor of History at Western Reserve University.

Excerpt from Our Treaty With Spain: Triumphant Diplomacy The event for which the country has been waiting with the keenest expectancy and impatience has at last transpired. The Treaty of Peace by which the war with Spain, temporarily ended by the Protocol of August 12th, has been finally terminated, peace restored to the two countries, and freedom and liberty assured to those whom this country was bound to, and did, protect, has been concluded and exchanged by the High Commissioners representing the two sovereign nations engaged in the struggle. All that now remains to make the treaty the supreme law of the land is for the President to transmit it for ratification to the Senate of the United States, in accordance with those provisions of the Constitution which clothe the President with "power, by and with the advice and consent of the Senate, to make treaties, provided two-thirds of the Senators present concur," and which also provide that "all treaties which shall be made under the authority of the United States shall be the supreme law of the land," and for the Senate to formally ratify it. The High Commissioners of the United States will, on their arrival from the scene of their labors, deliver the original draft of the treaty to the President, and thereupon will be relieved from further duties as Commissioners, although three of them will, in their capacity as Senators, have the further duty of voting for the ratification of the fruit of their labors by the body of which they are such distinguished members.
