El sistema de compensación del daño derivado de accidente de trabajo y enfermedad profesional es especialmente complejo, en cuanto implica la coordinación de cuatro instrumentos indemnizatorios del daño: prestaciones de la Seguridad Social, mejoras voluntarias, recargo de prestaciones e indemnización por daños y perjuicios. Como consecuencia de la dualidad de jurisdicciones competentes existente hasta recientemente, ha habido una importante discusión jurisprudencial acerca de la técnica de coordinación aplicable a estos cuatro instrumentos de compensación del daño. El presente artículo estudia las tres técnicas existentes de coordinación de instrumentos indemnizatorios y la utilizada en la compensación del daño derivado de accidente de trabajo y enfermedad profesional. El objetivo del estudio es determinar, desde la perspectiva del Análisis Económico del Derecho, si la técnica de coordinación empleada por los tribunales es adecuada para garantizar la íntegra reparación del daño y el nivel óptimo de prevención de riesgos laborales. El artículo incluye un estudio empírico sobre el quantum indemnizatorio otorgado por las salas civil y social del Tribunal Supremo, con la finalidad de determinar los efectos que la dualidad de jurisdicciones competentes y consiguientes diferencias en la técnica de coordinación aplicable ha tenido sobre la compensación del daño derivado de accidente de trabajo y enfermedad profesional. Workers' compensation systems due to industrial injuries and professional diseases in the Spanish legal system are especially complex, as it involves the coordination of four different compensation systems: Social Security benefits, voluntary improvements on Social Security benefits, surcharge on Social Security benefits and pain and suffering. As a result of the duality of jurisdictions that existed until recently, there has been an important discussion in Spanish courts regarding the compatibility between these four compensation mechanisms. This paper studies the three different coordination mechanisms and their application on Spanish workers' compensation. The aim of this analysis is to determine, from a Law & Economics perspective, if the coordination mechanism used by Spanish courts is adequate in terms of fully compensating the victim and providing the right incentives to employers to adopt the optimal level of risk prevention in the workplace. The paper includes an empirical study of the pain and suffering awards given by the civil and labor chambers of the Spanish Supreme Court, so as to determine the effects that the duality of jurisdictions and differences in the coordination mechanisms applied had on the compensation of work-related injuries.
