La production d'énergie nucléaire génère des risques environnementaux et sanitaires dont le risque d'accident. La gestion de ce risque présente deux dimensions: l'une préventive et l'autre compensatoire. Etant donné son caractère catastrophique et imprévisible, le risque nucléaire a toujours fait l'objet d'une gestion spécifique. En Europe, la gestion de ce risque est insatisfaisante. Le régime de responsabilité civile dont bénéficie l'industrie nucléaire conduit à un défaut d'internalisation du risque et à une insuffisance de la couverture des dommages. L'organisation de la couverture du risque nucléaire en Europe a été conditionnée par le régime de responsabilité civile mis en place. Dans sa forme actuelle, cette organisation est inefficace. Dans la perspective du lancement de nouveaux programmes électronucléaires en Europe, la gestion du risque nucléaire doit ètre reconsidérée afin de mieux répondre aux exigences d'internalisation, de prévention et d'indemnisation. Les exploitants devraient ètre soumis à une responsabilité illimitée et la couverture des dommages pourrait ètre améliorée par la mise en oeuvre d'un accord de risk-sharing entre exploitants.
