The biggest diaspora in Vietnamese history occurred between 1975 and 1992, when more than two million people fled by boat to escape North Vietnam's oppressive communist regime. Before this well-known exodus from Vietnam's shores, however, there was a massive population shift within the country. In 1954, one million fled from north to south to escape war, famine, and the communist land reform campaign. Many of these refugees went on to flee Vietnam altogether in the 1970s and 1980s, and the experiences of 1954 influenced the later diaspora in other ways as well. Massive refugee migrations in Southeast Asia set off in 1975 by changes of government in Vietnam, Cambodia, and Laos, are a problem of both humanitarian and political concern. The refugees pose potentially disruptive political problems for the asylum countries, Thailand, Malaysia, Indonesia, Singapore, the Philippines, and Hong Kong. Only a few countries, the United States, France, Australia, and Canada, have accepted an appreciable number of refugees for resettlement. In an effort to obtain worldwide participation in alleviating the Indochina refugee crisis, the United Nations High Commissioner for Refugees (UNHCR), has changed its funding program and has held international conferences aimed at obtaining more resettlement offers. It is imperative that appropriate asylum and additional temporary care facilities be provided and effectively managed. Current law does not clearly express U.S. intentions and commitments to refugee resettlement and has made planning and processing of refugees very difficult. Commitments need to be more formally embodied in law to express the will of Congress and possibly to motivate other nations to share refugee relief. A refugee admission and resettlement policy needs to be established.

The international response agreed on in Geneva in 1979 was in line with Western Cold War values, but by 1988 it had begun to unravel. The new international response took the form of the Comprehensive Plan of Action for Indochinese Refugees (CPA), which was in place from 1989 to 1996. This paper offers a detailed look at the process of negotiating the CPA, its contents, how it was received, and its implementation. At the time it was agreed, the CPA was revolutionary in two ways: first, it was comprehensive, and second, it was predicated on the right of Vietnamese boat people to land and to be processed for refugee status. As a result, the CPA both saved lives and marked the transition from blanket recognition of refugee status to individual status determination -- all in a region whose countries had not ratified the Refugee Convention." --
