Indigenous peoples have long sought recognition and autonomy over the territories that they have lived in since before the colonization of their lands. While the road for recognition and autonomy has been a long one for indigenous peoples, towards the end of the 20th century there began to be a rise in provisions protecting these indigenous and tribal peoples. Many countries, particularly in Latin America, began to incorporate protections for indigenous groups into their constitutions. At the same time, these discussions were also happening on an international scale resulting in international agreements aimed at protecting indigenous rights. The success that these events have had, however, remains unclear. While these reforms and new policies have the potential to do much good for indigenous groups, it is also possible that these new provisions result in a complicated system that further restricts the rights of indigenous groups. The research question being asked is why governments in Latin America adhere, or not adhere, to autonomous claims made by indigenous groups. In order explore this question, court cases from Mexico and Venezuela will be analyzed in order to see how effective the constitutional guarantees and international treaties are at allowing indigenous peoples to exert autonomy. Two court cases from Mexico will be analyzed (from before and after constitutional reforms) along with one from Venezuela (following constitutional reform). It appears that for high levels of government adherence to indigenous autonomy in a country, it is required that a country possesses both domestic constitutional guarantees for indigenous groups and has ratified I.L.O. no. 169.
