This report provides an overview about the functioning of the EU Plant Protection Product authorisation process in several EU Member States and if it is in line with requirements laid down in Regulation (EC) No 1107/2009. The purpose of this regulation is to ensure a high level of protection of both human and animal health and the environment. It sets out the requirements, procedure and timeframes for authorisation of Plant Protection Products and established a zonal system of authorisation in the EU to enable a harmonised and efficient system to operate. The report finds that the zonal system laid down in the Regulation is not working effectively and deadlines for authorisation are not met by the majority of Member States as they do not avail of the opportunities to share work among them and they have not taken measures to compensate this lack of work sharing. As a result, the objective of the Regulation to ensure a high level of protection of both human and animal health and the environment and to improve the functioning of the internal market in the Member States is undermined.

Substances used to suppress, eradicate and prevent organisms that are considered harmful are grouped under the term ‘pesticide’. The term includes both plant protection products (used on plants in agriculture, horticulture, parks and gardens) and biocidal products (used in other applications, for example, as a disinfectant or to protect materials). Pesticides can be useful in a number of circumstances, for example, in overcoming diseases and increasing agricultural yields. However, they are not without their disadvantages - above all, their environmental impact, the risks that they pose to human health and their effects on crop protection. European Union pesticide legislation is designed to ensure a high level of protection for human health and the environment and to improve the functioning of the internal market. Plant production products and biocides are subject to a dual approval process: active substances are approved at EU level and products are subsequently authorised predominantly at Member State level. Furthermore, standardised maximum levels are set for the residues of plant protection products in food, and a framework for action is focused on sustainable pesticide use. A number of aspects of European Union policy on pesticides can be considered as either opportunities or challenges, in particular, issues surrounding costs for the industry, the approval process, and sustainability. The Commission is currently assessing the legislation on plant protection products and their residues. The conclusions of that study are expected by the end of 2018.

Regulation (EC) 1107/2009 lays down the main instruments for placing effective plant protection products (using pesticide substances) on the market that are safe for humans, animals and the environment, while at the same time ensuring effective functioning of the internal market and improved agricultural production. This European Implementation Assessment found that the above objectives, while largely relevant to real needs, are not being achieved in practice. In particular, implementation of the main instruments of the regulation – substance approval, plant protection products authorisation and enforcement of the regulatory decisions taken in the frame of the approvals and authorisations, is problematic, which also affect other related EU policies. Nevertheless, despite the implementation challenges observed, stakeholders – including national competent authorities, health/environment NGOs, manufacturers of substances and plant protection products and their users (farmers) – agree that the EU is the appropriate level at which regulatory action in the field of pesticides (used in plant protection products) should continue to take place.
