This report provides an overview of a European Commission project on import controls for plant health. The objectives of the project were to evaluate Member States' capacity and performance of import controls on plant health, to identify and promote best practice across the Union, and to support the development of implementing legislation under the new Plant Health Law and Official Controls Regulation. The project did not find any significant shortcomings with import control procedures for plant health, but identified substantial differences between Member States in their capacity and implementation of import checks. The report highlights some of the many examples of good practice and critical points that were identified by the project and the action taken subsequently by the Commission and Member States during the development of the new plant health regime.

Updated as of May 29, 2018 We are revising and reorganizing the regulations pertaining to the importation of fruits and vegetables to consolidate requirements of general applicability and eliminate redundant requirements, update terms and remove outdated requirements and references, update the regulations that apply to importations into territories under U.S. administration, and make various editorial and nonsubstantive changes to regulations to make them easier to use. We are also making substantive changes to the regulations, including: Establishing criteria that, if met, will allow us to approve certain new fruits and vegetables for importation into the United States and to acknowledge pest-free areas in foreign countries more effectively and expeditiously and doing away with the practice of listing in the regulations specific commodities that may be imported subject to certain types of phytosanitary measures. These changes are intended to simplify and expedite our processes for approving certain new imports and pest-free areas while continuing to allow for full public participation in the processes. This rule revises the structure of the fruits and vegetables import regulations and establishes a new process for approving certain new commodities for importation into the United States. It does not, however, allow the importation of any specific new fruits or vegetables, nor does it alter the conditions for importing currently approved fruits or vegetables except as specifically described in this document. To the extent that our trading partners consider the length of time it takes to conduct the rulemaking process a trade barrier, these changes may facilitate the export of U.S. agricultural commodities by reducing that time for fruits and vegetables that meet this rule's criteria. The changes do not alter the manner in which the risk associated with a commodity import request is evaluated, nor do they alter the manner in which those risks are ultimately mitigated. This report describes the outcome of a series of audits in non-EU countries to evaluate the system of official plant health controls for the export of plants for planting and seeds to the European Union. Official controls in the exporting countries are not always carried out in line with EU requirements concerning their scope or are insufficiently thorough and do not guarantee that the plants are free from harmful organisms. This means a plant health risk for the EU. The competent authorities in the exporting countries have difficulties with interpreting EU import rules and organising the inspections accordingly. To address the issues highlighted in the report, the EU regularly updates the import rules taking into consideration the plant health risk and the audit findings. In addition, EU and other international aid programmes provide assistance in developing phytosanitary controls in the exporting countries.

Beyond Compliance: A Production Chain Framework for Plant Health Risk Management in Trade provides a series of decision support tools that can be used to manage and demonstrate plant health risk management. The tools, developed within a production chain framework and Systems Approach, were developed using real trade cases in Southeast Asia. The project aimed to support national plant protection organisations and trade negotiators seeking to ensure safe trade with more risk-proportionate and suitable risk management plans. The Beyond Compliance project was funded by the Standards and Trade Development Facility, a global partnership established by the Food and Agriculture Organization of the United Nations, the World Bank, the World Health Organization, the World Organisation for Animal Health and the World Trade Organization.
