This book by the ETUI Transnational Trade Union Rights Expert Network analyses enforcement as a key element making EU labour law effective or ineffective. Enforcement is the key ingredient that makes rights effective and ensures compliance. It can make or break a legal system. Despite this, enforcement of EU labour law has received little scholarly attention in recent decades and has rarely been examined in a comprehensive way. This book aims to fill this gap. Intended for academics and practitioners alike, the book adopts a threefold approach to examine this issue. First of all, it explores the idea of effective enforcement and sets out the wider context in which EU labour law enforcement takes place. Secondly, it analyses how enforcement operates in particular areas, including non-discrimination, health and safety, information and consultation rights, and the rights of migrating workers. Thirdly, it critically assesses the role of specific actors (in particular collective actors like trade unions, as well as whistle-blowers and the European Labour Authority) and settings (public procurement, economic and monetary policy) regulated by EU law. Drawing on the insights produced by these analyses, the book concludes by proposing a comprehensive Draft for a Model Directive on 'Effective Enforcement of EU Labour Law' as an inspiration for policy development and scholarly debate in this area.

This monograph is an outcome of research completed within the Visegrad Grant “Workplace Whistleblower Protection in the V4 Countries, France and Slovenia” – WhistlePro (2020–2021), financed from the International Visegrad Fund. The project aims to contribute to the improvement of the legal framework in the Visegrad countries concerning the protection of workplace whistleblowers and, indirectly, to the change of workers’ attitudes towards whistleblowing. Contributions prepared by legal experts from various countries and universities concern matters of universal importance such as freedom of expression relative to whistleblowing, personal scope of the EU Whistleblower Protection Directive (2019/1937) or personal data protection. They also discuss the legal situation concerning whistleblower protection in the Visegrad countries, France and Slovenia and present recommendations for changes in the respective countries. The monograph culminates with a summary of proposals for the improvement of the legal situation of persons disclosing breaches of law in the work-related context. The SARS-CoV-2 virus pandemic has halted the global economy and forced its reorganization on many levels. This phenomenon caused a shock, the effects of which will be felt for a long time both on the micro and macro scale. Creative industries, including the fashion and design industries (Textile, Clothing, Leather, and Footwear, TCLF) that are the subject of this publication, are struggling to maintain normal levels of production, employment, financial liquidity. They must additionally confront new challenges in the areas of intellectual property rights and their approach to the e-commerce world. Businesses found themselves faced with an uncertain future and new obstacles, but also with opportunities. These challenges now affect the traditionally fastpaced fashion sector, which has been driven for many years by consumers’ desire for ever more design and by the industry’s own thirst for profit. In the Polish perspective, it should also be borne in mind that, according to the report of PKO Bank Polski in 2019, the clothing industry in Poland showed an upward trend, ranking the country in 8th place in Europe by size of the clothing sector in 2017. As for the entrepreneurs making clothing, in 2017 there were 12,700 of them, placing Poland third in Europe. Finally, for employment, in the same year in Poland, 85,000 were employed in the clothing sector, which was the 5th place in the European ranking. These statistics clearly demonstrate why this sector requires closer analysis in these changed times, including a refreshed SWOT analysis taking account of the new reality. Given this situation, the Center for Design, Fashion and Advertising Law of the University of Silesia initiated research to determine how the clothing sector in Poland is coping and how the legal environment interacts with the Covid challenges. Thanks to a joint effort of scientists and legal practitioners, this publication was created consisting of 39 chapters grouped into the following 12 parts: Social and legal context, International and regulatory context, Product safety, Contracts, Copyright law, Design law and trademark law, Technology law, Unfair competition law, Labour law, Fine arts market, Sustainable Development, E-commerce. The editors would like to thank all of the authors for their efforts examining the development trends in the TCLF sector and for contributing the immeasurable amounts of energy and understanding that allowed us to complete this project. This book is the result of the authors’ significant commitment. Editors would like to give special thanks to Śląski Holding Przemysłowy that shared the company’s expertise about their two large industrial production plants employing over 500 employees, which kept working in a continuous operation system, without a single case of infection by COVID-19. "For employees, collective protection has never been more urgent. Everywhere, pressures resulting from worldwide competition and technical innovation are downgrading and relocating jobs, closing companies, and fuelling workers' fears of less-than-secure working conditions, de-qualification, and job loss. More and more, trade unions confront the challenge of asserting their rights across borders. However, in order to establish the necessary preconditions for any transnational solidarity, it is necessary to define and clarify both what is distinctive and what is fundamental in the different legal frameworks affecting trade union activity. That is what this book sets out to do. The essays presented here are an outcome of an international and comparative conference, organised and sponsored by the newly established Hugo Sinzheimer Institute of Labour Law (HSI), Frankfurt am Main, which took place in Frankfurt in January 2011 at the premises of IG Metall, the world's largest trade union. The book offers an overview of trade union rights in each of seven industrial countries: Belgium, Hungary, England, Germany, France, the Netherlands and the United States.
